PUBLIC NOTICE Ordinance No. 581 Title 12, Land Use Regulations, Amendment Sections 332 (6), 650 B., 484 B. and Appendix A Bonner County Revised Code An Ordinance of Bonner County, Idaho, setting forth its authority; amending Bonner County Revised Code Title 12 (Land Use Regulations), to make the following changes to the Sections 332 (6), 650 B., 484 B., and Appendix A.; Providing for severability, and providing for an effective date. Whereas, Idaho Code, Title 67, Chapter 65, provides for the adoption of land use standards and processes for the purposes of protecting property rights and enhancing property values, together with the purposes of promoting the health, safety, and general welfare of the people and to ensure that the development on land is commensurate with the physical characteristics of the land; and Whereas, The Board of County Commissioners has amended these sections in accordance with Idaho Code 67-6511; and Whereas, Idaho Code 67-6511 provides for the governing board to establish standards to regulate and restrict uses and standards within the varing zone districts in the County; and Whereas, The Board of County Commissioners initiated a review of the Title 12, sections 332 (6), 650 B., 484 B., and Appendix A to identify ways to decrease intensity, expense and processing of land division applications; and Whereas, the Bonner County Planning and Zoning Commission did hold a public hearing September 20, 2018, on the amendment and did recommend approval to the Board of County Commissioners; and Whereas, the Bonner County Board of County Commissioners did hold a public hearing on October 24, 2018, on the proposed amendments to Bonner County Revised Code Title 12, providing notice for such hearings as required by Idaho Code, Title 67, Chapter 65. Now, therefore be it ordained by the Board of County Commissioners of Bonner County, Idaho that the following be and is hereby adopted as an ordinance of Bonner County: Section 1: Authority This Ordinance is adopted pursuant to the authority granted at Chapter 65, Title 67, Idaho Code, and pursuant to the procedural requirements contained at Section 67-6509, Idaho Code. Section 2: Amending Bonner County Revised Code Title 12, Sections 332 (6), 650 B., 484 B., and Appendix A. BCRC 12-332 Residential Use Table Standards (6) Multi-family dwellings with a minimum of 12,000 square feet of lot area for the first unit, plus 3,000 square feet for each additional unit; provided, that all urban services are available. BCRC 12-650 Minor Land Division Procedure B. Procedure: Applications for a minor land division which contain four (4) or fewer contiguous lots under common ownership may be processed as "minor land divisions" as set forth in this section and section 12-651 of this subchapter; provided, that no planned unit development is requested to accommodate the proposed lot sizes. BCRC 12-484 B. Vacation Rental Permit Procedures Site plan. Appendix A: Private Road Standards Manual SECTION 0: PURPOSE AND AUTHORITY It is the purpose of this manual to provide consistent standards for construction of new private roads built in Bonner County and reconstruction or renovation of existing private roads for subdivisions, in Bonner County. All construction shall conform to the standards set forth in this manual. The Board of County Commissioners is authorized to waive requirements of Appendix A upon satisfaction of the criteria of this section. The purpose of granting a waiver under the provisions of these regulations shall be to ensure that an applicant is not unduly burdened as opposed to merely inconvenienced by the Private Road Standards. The Board shall not approve any waiver(s) except finding that all of the following apply: 1. The granting of the waiver will not result in impacts that are detrimental to the public safety, health or welfare or injurious to other property. 2. Granting the waiver shall substantially secure the objectives, standards and requirements of these regulations. 3. A practical hardship, or unnecessary and unreasonable expense, would result from strict compliance with the foregoing regulations. 4. The purpose of these Private Road Standards may be served to a greater extent by an alternative proposal, or where such requirements are redundant and clearly unnecessary for the land division in a particular area. Section 3: Severability The provisions of this Ordinance are hereby declared to be individually severable. Should any provision of this ordinance be declared invalid by a court of competent jurisdiction, such declaration shall not affect the validity of the remaining provisions. ADVERTISEMENT REQUEST FOR PROPOSALS City of Sandpoint On-Call Snow Removal Services Separate sealed PROPOSALS for On-Call Snow Removal Services located in Sandpoint, Idaho will be received by City of Sandpoint at 1123 Lake Street, Sandpoint, ID 83864, until 2:00:00 p.m. local time on Thursday, November 15th, 2018 and then at said office publicly opened and read aloud. The work is for on-call, Contractor-owned, heavy equipment and operators to support City snow removal services. Contractors are encouraged to submit proposals that identify equipment which could be available at a pre-determined rate to work in conjunction with City staff and equipment. The City typically performs snow removal services between November 1 and March 1 within City jurisdiction on public streets, public parking lots and pathways, and sidewalks adjacent to City property. On-Call Snow Removal Services are anticipated to include three general categories of service: (a) hauling of snow to City designated locations for storage, (b) snow plowing of parking lots, and/or (c) snow plowing of pathways and/or sidewalks. Contractor Proposal Form lists a variety of equipment types that may be required to support any one or more category of service. It is not necessary to propose on all equipment listed; Contractor proposals should only list that equipment it is able to commit to On-Call Snow Removal Services that are owned by the Contractor. All operators employed by the Contractor providing services for the CITY shall possess a valid driver license and a CDL in the State of Idaho, as applicable by law, and be equipped with a radio capable of communicating with CITY operators. Contractor shall perform this Contract as an independent contractor, and as such shall have and maintain complete control over all of its employees, agents, representatives, and operations. Neither Contractor nor anyone employed by it or its delegate or subcontractors shall be or be deemed to be or act or purport to act as the agent, representative, employee, or servant of CITY. The Contractor shall not subcontract the Snow Removal Services.
