Isn’t killing a baby cruel and unusual punishment?

The celebratory standing ovation by the New York state legislators upon passage of a seemingly no-restrictions abortion bill got me thinking … does New York have capital punishment? The answer is no. The death penalty was abolished in 2007. You know, the 8th Amendment, “cruel and unusual” punishment?

So, let me get this straight. In New York state a person convicted of a pre-2007 crime which could have warranted execution, now gets life on the taxpayers’ dime, while a baby, who has broken no law, can suffer the death penalty, legally, seconds before birth?

Killing a baby is not cruel and unusual punishment? Could someone wiser please explain this in words I can understand?
