ORDINANCE NO. 615 AN ORDINANCE OF THE CITY OF PRIEST RIVER, BONNER COUNTY, IDAHO, PROVIDING FOR AUTHORITY; AND PROVIDING FOR DE-ANNEXATION OF LANDS FROM THE CITY; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council did adopt Ordinance 515 on September 22, 2008 resulting in the annexation of lands; and WHEREAS, said annexation was conducted in accordance with Category A annexations as identified at §50-222(3)(a); and WHEREAS, the development plans for the area in 2008 have not been pursued; and WHEREAS, certain properties described in Exhibit A and depicted in Exhibit B have requested and received de-annexation from the City from time to time; and WHEREAS, in 2019 the City sent a mailing to subject landowners asking their opinion on de-annexation and the response from the majority of landowners was to de-annex; and WHEREAS, the City Council considered said de-annexation and received testimony at a public hearing held December 7, 2020 and continued deliberations on December 21, 2020 at a regular business meeting; and WHEREAS, the City Council desires to proceed with the de-annexation; NOW THEREFORE, THE CITY COUNCIL OF PRIEST RIVER, IDAHO HEREBY ORDAINS AS FOLLOWS: SECTION 1 The described lands laying easterly of the line described in Exhibit A, by this reference incorporated herein, in accordance with provisions contained in Title 50, Chapter 2, Idaho Code, pertaining to cities setting their own boundaries, are hereby de-annexed from the City of Priest River. SECTION 2 The provisions of this ordinance are hereby declared to be individually severable. Should any provisions of this ordinance be declared invalid by a court of competent jurisdiction, such declaration shall not affect the validity of the remaining provisions. SECTION 3 This ordinance shall be in full force and effect January 1, 2021 after recording with the Bonner County Clerk and publication in one issue of the Bonner County Daily Bee. LEGAL NOTICE In accordance with Idaho Code sections 36-104(b) and 36-104(e), and the 2020 Big Game Proclamation of the Idaho Fish and Game Commission, Game Management Units 75, 77, and 78 are closed to the harvest of male mountain lion, effective immediately. The harvest limits for male mountain lions have been met in these units. A dog training season (pursuit only) for male mountain lion in these units will be open immediately and shall close March 31, 2021. Units 75, 77 and 78 remain open to harvest for females only, consistent with limits established in the 2020 Big Game Proclamation.
