SUMMARY OF CITY OF SANDPOINT ORDINANCE 1372 Municipal Water System AN ORDINANCE OF THE CITY OF SANDPOINT, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO; AMENDING PORTIONS OF TITLE 7, CHAPTER 6, SANDPOINT CITY CODE, PERTAINING TO THE SANDPOINT MUNICIPAL WATER SYSTEM; PROVIDING THAT THIS PROVISION SHALL BE DEEMED SEVERABLE AND THAT REMAINING SECTIONS OF SANDPOINT CITY CODE SHALL NOT BE AFFECTED BY A FINDING THAT THESE PROVISIONS ARE UNLAWFUL OR UNENFORCEABLE; AND PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE. A summary of the provisions of Ordinance 1372, amending Sandpoint City Code Title 7, Chapter 6, as follows: Section 1 reflects amendments to Title 7, Chapter 6, to include (a) omitting content that is duplicated in the Municipal Water System Rules and Regulations, (b) moving content from the Code to the Municipal Water System Rules and Regulations, (c) adding or modifying content in accordance with current standard practices, (d) updating definitions for consistency with state law, (e) omitting content that is legally non-standing, and (f) re-codifying penalty provisions under this chapter. These amendments also include omitting the existing requirement that applicants for water service pay a deposit as a guarantee of payment of water service fees, with an alternative practice reflected in the proposed new Rules and Regulations that assesses a flat rate meter/connection fee (per meter size) at the same time all other fees are paid, with the flat rate meter/connection fee applied at the same rate as the currently-adopted deposit rates, and any changes in the amounts included and presented to City Council with the annual fee schedule during the budget review process. Sections 2 and 3 provide for repeal and severability and an effective date. This publication is a summary of the full Ordinance, and is being published pursuant to Idaho Code Section 50-901A. This ordinance was passed and approved upon a proper roll call vote and duly enacted at a properly-noticed session of the Sandpoint City Council, held March 4, 2020.
