SUMMARY OF CITY OF SANDPOINT ORDINANCE NO. 1385 New Construction of Curbs, Gutters and Drainage Appurtenances and Stormwater Management AN ORDINANCE OF THE CITY OF SANDPOINT, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AMENDING SANDPOINT CITY CODE TITLE 7, CHAPTER 3, SECTION 9, NEW CONSTRUCTION OF CURBS, GUTTERS AND DRAINAGE APPURTENANCES, AND TITLE 11, CHAPTER 3, STORMWATER MANAGEMENT, PROVIDING FOR REPEAL AND SEVERABILITY, AND PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE. Following is a summary of the provisions of Ordinance No. 1385. Ordinance Section 1 amends Sandpoint City Code Title 7, Chapter 3, Section 9, New Construction of Curbs, Gutters and Drainage Appurtenances, to provide that this section shall apply to all zones, as required by Title 10 - Subdivisions, where new streets are constructed, or as determined necessary by the City Engineer in conjunction with a building permit or parking lot construction to satisfy the provisions of the Stormwater Management Ordinance, that curbs, or curbs and gutters, shall be constructed to conform to the Idaho Standards for Public Works Construction (latest edition) or as otherwise amended by the City Engineer, and eliminates in its entirety subsection C, "No Curbing Required". Ordinance Section 2 amends Sandpoint City Code Title 11, Chapter 3, Section 3, General Requirements, to provide that a stormwater management plan will not be required for detached, single-family dwelling structures, including accessory structures thereto and duplexes, and that single-family dwelling structures and accessory structures thereto shall provide and maintain erosion and sediment prevention measures in accordance with the best management practices established by the City. Ordinance Section 3 amends Sandpoint City Code Title 11, Chapter 3, Section 13, Training and Certification, providing that those constructing detached, single-family dwelling structures and accessory structures thereto are exempt from the requirement to possess stormwater certification or to have someone with this certification immediately available and, additionally, eliminates section C in its entirety, which provided for conditions of acceptance of certifications from other entities. Ordinance Sections 4 and 5 provide for repeal and severability, publication and an effective date. This publication is a summary of the full Ordinance and is being published pursuant to Idaho Code Section 50-901A. Following is a summary of the provisions of Ordinance No. 1386. Ordinance Section 1 amends Sandpoint City Code Title 9, Chapter 1, Section 5, to eliminate portions of this section pertaining to Accessory Buildings, Regulations, that are outdated, redundant, unnecessary or not applicable. Ordinance Section 2 amends Sandpoint City Code Title 9, Chapter 1, Section 8, providing that only site-built accessory dwelling units (ADU) will be permitted, requiring compliance with City Code Title 8, Building Regulations, increasing the maximum permitted size of an ADU from 650 to 900 square feet, providing that ADUs not situated over a garage must be situated behind the primary dwelling, providing that an ADU shall comply with the setbacks for accessory structures required by the base zoning district in which it is located, and providing for rules and regulations for non-conforming ADUs in existence prior to November 19, 2008. Ordinance Section 3 amends Sandpoint City Code Title 9, Chapter 9, Section 6-B-2, to add a statement under Supplementary Conditions and Safeguards, providing that under no circumstances shall the Planning Commission or City Council consider a request for variance after issuance of a building permit.
