ORDINANCE NO. 620 AN ORDINANCE OF THE CITY OF PRIEST RIVER, BONNER COUNTY, IDAHO, PROVIDING FOR AUTHORITY; AND PROVIDING FOR DE-ANNEXATION OF LANDS FROM THE CITY; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the previous City Councils of the City of Priest River followed procedures resulting in the annexation of lands into the City over time; and WHEREAS, said annexations appear to have been conducted in accordance with Idaho Code in effect at those times and were accepted by Bonner County Commissioners and the State Tax Commission; and WHEREAS, comparisons were conducted of said annexation documents to the official Idaho State Tax Commission map and Bonner County GIS Department mapping defining City boundaries; and WHEREAS, said comparison identified various inconsistencies and the City is working with the Bonner County GIS Department to eliminate such inconsistencies and provide the Tax Commission with reconciled mapping; and WHEREAS, a landowner of a 23+/- acre parcel has requested de-annexation of the small portion of their lands which current State and County mapping indicated lies within the City; and WHEREAS, a review of annexation documents of this area indicate an error may have occurred identifying annexed parcels using Tax Parcel Numbers rather than using metes and bounds descriptions of said parcels; and WHEREAS, said mapping referenced above is preventing the landowner from acquiring certain permitting from Bonner County; and WHEREAS, the City Council considered said de-annexation on June 21, 2021 at a regular meeting of the Council, and WHEREAS, the City Council desires to proceed with the de-annexation. NOW THEREFORE, THE CITY COUNCIL OF PRIEST RIVER, IDAHO HEREBY ORDAINS AS FOLLOWS: SECTION 1 All lands described in Exhibit A and generally depicted on Exhibit B, by this reference incorporated herein, in accordance with provisions contained in Title 50, Chapter 2, Idaho Code, pertaining to cities setting their own boundaries, are hereby de-annexed from the City of Priest River. SECTION 2 The provisions of this ordinance are hereby declared to be individually severable. Should any provisions of this ordinance be declared invalid by a court of competent jurisdiction, such declaration shall not affect the validity of the remaining provisions. SECTION 3 This ordinance shall take effect and be in full force upon recording and publication according to law. This ordinance or its summary shall be published in one issue of the Bonner County Daily Bee, which is hereby declared to be the official newspaper of the City for the publication of this ordinance.
