ORDINANCE NO. 624 AN ORDINANCE OF THE CITY OF PRIEST RIVER, BONNER COUNTY, IDAHO, PROVIDING FOR AUTHORITY; PROVIDING FOR ANNEXATION OF LANDS INTO THE CITY; PROVIDING FOR ZONING DESIGNATION OF SAID LANDS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council did request annexation of City-owned lands referred to as the Joslyn Property, generally located south of Highway 2 and east of the Bonner County Park in Section 25, Township 56 North, Range 5 West, Boise Meridian, Bonner County, Idaho; and WHEREAS, the City, as the subject landowner, directed the Planning & Zoning Department to process a request for annexation and the City Council considered said request in accordance with §50-222, Idaho Code and specifically Category A annexations as identified at § 50-222, (3) (a); and WHEREAS, the City Council concludes the requested annexation meets the requirements of Category A annexations and the annexation is appropriate; and WHEREAS, the City requested said lands be zoned Municipal; and WHEREAS, the City Council held a duly noticed public hearing resulting in the annexation and designation of the zoning of the subject. NOW THEREFORE, THE CITY COUNCIL OF PRIEST RIVER, IDAHO HEREBY ORDAINS AS FOLLOWS: SECTION 1: ANNEXED LANDS The following described lands, in accordance with provisions contained in Title 50, Chapter 2, Idaho Code, are hereby annexed into the City of Priest River: The land described herein is situated in the State of Idaho, County of Bonner, and is described in attached Exhibit 1 and depicted on attached Exhibit 2 which are incorporated herein. SECTION 2: ZONING OF ANNEXED LANDS The annexed lands identified in Section 1 are hereby zoned Municipal. The official zoning map of the City is hereby amended to reflect said annexation and zoning. SECTION 3: SEVERABILITY The provisions of this ordinance are hereby declared to be individually severable. Should any provisions of this ordinance be declared invalid by a court of competent jurisdiction, such declaration shall not affect the validity of the remaining provisions. SECTION 4: EFFECTIVE DATE This ordinance shall take effect and be in full force upon recording and publication according to law. This ordinance or its summary shall be published in one issue of the Bonner County Daily Bee, which is hereby declared to be the official newspaper of the City for the publication of this ordinance.
