Notice of Public Hearing Notice is hereby given that a public hearing pursuant to Idaho Code and Dover City Code has been set for Dover City Council at 6 p.m. on March 20, 2023, at Dover City Hall, 699 Lakeshore Ave., Dover, to consider the following: The City of Dover will conduct a public hearing to consider public comment on proposed new and/or increased fees for actual costs of services and materials listed in the fee schedule. The reason for the proposed fee changes is to reflect the costs of services and materials reasonably related to but not exceeding the actual cost of the service being rendered. The proposed fee changes include: a separate fee category for stormwater/site disturbance review not associated with other permits; engineering costs to review violations; an increase for floodplain development permit applications; increases for building fees for temporary certificates of occupancy and zoning site permit reviews; building code violations to include failure to obtain a certificate of occupancy; a new fee category for miscellaneous administrative appeals; added fees for additional sewer and water inspections; inclusion of building code violations in category for water turn off fees; and a new fee for manual water meter reading. SPECIAL MEETINGS On Tuesday, January 3, 2023 a Special Meeting with West Pend Oreille Fire District was held pursuant to Idaho Code §74-204 (2). On Wednesday, January 4, 2023 a Planning Appeal Hearing was held pursuant to Idaho Code §74-204 (2). Commissioner Connolly made a motion to affirm the Hearing Examiner’s decision (deny the proposed variance request) on this project FILE V0015-22, requesting for the creation of a 1.54-acre parcel and a 3.06-acre parcel where the minimum required lot size is 5-acres, based upon the following conclusions: Site conditions do apply to neighboring lots and the request is needed based on actions of the owner. The topographical conditions are not sufficient grounds for the creation of two separate lots. The highway easement would likely alter the size of neighboring properties, not the subject parcel alone. In addition, the granting of this proposal would prove to be inconsistent with the Bonner County Revised Code per BCRC 12-342 (C).The decision is based upon the evidence submitted up to the time the Staff Report was prepared and testimony received at this hearing. I further adopt the following findings of fact and conclusions of law as written in this staff report or as amended during this hearing. This action does not result in a taking of private property. The action that could be taken, if any, to obtain the variance is to: 1) File a new application with the Planning Department and meet the standards required by Bonner County Revised Code; or 2) Appeal the Bonner County Commissioners decision to the courts.
