Chamber voices support for LPOSD continuous levy

The Greater Sandpoint Chamber of Commerce Board of Directors supports making the levy continuous for the Lake Pend Oreille School District. A “yes” vote on Nov. 5 will make the current levy permanent and help the school district maintain our academic programs, technology, and extracurricular activities. This vote will enable the same level of support for future years, without voting every two years.

With the levy supporting so much in the Lake Pend Oreille School District we must graciously take on the responsibility to keep our rural schools open, offer decent jobs to our community members, and keep extracurriculars accessible to a generation who needs them more than ever.

Williamson is the best choice for Sandpoint mayor

Shannon Williamson is an excellent candidate for mayor. She is a proven leader, thoughtful, intelligent and has a thorough understanding of the issues the city faces both internally and externally. Some may argue with the timing of her run. I have some concerns about that as well. However, she is the best choice and will make an excellent mayor who will exercise the duties and responsibilities of the office in a way that will benefit all.

Longtime Panhandle Health District nurse, Michiko Kondo, 91, died on Oct. 26, 2019 in Seattle, Washington. Michiko Matsumoto was born to Ryoichi Matsumoto and Yoshi Yabuki Matsumoto on May 6, 1928, in San Diego, California. She was the third of four children and was predeceased by older sister Tami and younger brother Kazuo. Michi and her family were sent to an internment camp during World War II; Camp 3 at Poston, Arizona. She was able to leave the camp to finish high school in Evanston, Illinois.

A few more thoughts on Sandpoint mayoral candidates

For someone whose top priority is the environment, it’s tough to watch the Sandpoint mayoral race. Two candidates have shown concern for the environment and the local effects of the climate crisis, but will likely split the vote and both lose. Shannon Williamson has made protecting the environment her professional priority for years and served on the board of 350Sandpoint when the membership was less than a dozen. Mayor Shelby Rognstad has supported climate change awareness in the community, has experience in the job and has been a good mayor.

For the last 20 years the Lake Pend Oreille School District has demonstrated excellent fiscal responsibility. They have also steadily increased student achievement. They go hand in hand. The reason we have a maintenance & operations levy in the first place is the Idaho Legislature recognizes that they do not fully fund K-12 education. That is why they gave the school districts the ability to back fill the deficit with a local maintenance & operations levy.

Ordinance No. 591 Title 12, Land Use Regulations, Amendment Sections 611, 650-680. Bonner County Revised Code An Ordinance of Bonner County, Idaho, setting forth its authority; amending Bonner County Revised Code Title 12 (Land Use Regulations), to make the following changes to Sections 611, 650-680; Providing for severability, and providing for an effective date. Whereas, Idaho Code, Title 67, Chapter 65, provides for the adoption of land use standards and processes for the purposes of protecting property rights and enhancing property values, together with the purposes of promoting the health, safety, and general welfare of the people and to ensure that the development on land is commensurate with the physical characteristics of the land; and Whereas, The Board of County Commissioners has amended these sections in accordance with Idaho Code 67-6511; and Whereas, Idaho Code 67-6511 provides for the governing board to establish standards to regulate and restrict uses and standards within the varing zone districts in the County; and Whereas, The Planning Department initiated a review of the Title 12, Sections 611, 650-680 to identify ways to further improve processes and increase clarity in processing of land division applications; and Whereas, the Bonner County Planning and Zoning Commission did hold a public hearing September 19, 2019, on the amendment and did recommend unanimous approval to the Board of County Commissioners; and Whereas, the Bonner County Board of County Commissioners did hold a public hearing on October 23, 2019, on the proposed amendments to Bonner County Revised Code Title 12, providing notice for such hearings as required by Idaho Code, Title 67, Chapter 65. Now, therefore be it ordained by the Board of County Commissioners of Bonner County, Idaho that the following be and is hereby adopted as an ordinance of Bonner County: Section 1: Authority This Ordinance is adopted pursuant to the authority granted at Chapter 65, Title 67, Idaho Code, and pursuant to the procedural requirements contained at Section 67-6509, Idaho Code. Section 2: Amending Bonner County Revised Code Title 12, Sections 611 and 650-680. 12-611 DEFINITIONS The term subdivision shall not include: ADD: I. Minor Land Divisions Retitle and move the following: Subchapter 6.5 - Short Plats, Procedures Subchapter 6.6 - Minor Land Divisions Subchapter 6.7 - Lot Line Adjustments Subchapter 6.8 - Condominium Projects 12-660: MINOR LAND DIVISION PROCEDURE: A. Purpose: To ensure that land divisions comply with the applicable zoning regulations; to establish a ministerial review of all land divisions; and to expedite the process for those small divisions of land that conform to the existing zone regulations in which the division lies. (Ord. 557, 11-10-2016) B. Procedure: Applications for a minor land division which contain four (4) or fewer contiguous lots under common ownership may be processed as "minor land divisions" as set forth in this section and section 12- 661 of this subchapter; provided, that no planned unit development is requested to accommodate the proposed lot sizes. (Ord. 581, 10-24-2018) C. Permit Required: Lots created by a minor land division, shall only be eligible for one minor land division for a period of not less than two (2) years. Land divisions done prior to the end of the two (2) year period shall be processed as a subdivision or short plat. D. Application: The application for a minor land division shall include: 1. Application: Prior to recordation of a deed or MLD plat, each application for a minor land division shall be submitted on a form provided by the Planning Department with appropriate fees approved by the Board of County Commissioners. 2. Design Criteria: The MLD shall conform to the following design criteria: a. Any new and existing easements or roads showing access to each property, considering alignment with existing or planned roads. b. All proposed lots which are three hundred feet (300') or less in width shall maintain a depth to width ratio of not greater than three to one (3:1); and lots which are more than three hundred feet (300') in width shall maintain a depth to width ratio of not greater than four to one (4:1). All proposed lots one hundred feet (100') or less in width shall be designed so that the angle of intersection of the side lot lines with the fronting road is between eighty five (85) and ninety five degrees (95), for a distance of not less than fifty feet (50') from the point of intersection. Submerged lands are exempt from the requirements herein. (Ord. 501, 11-18-2008) c. Lands below the applicable natural or ordinary water mark, or the applicable artificial high water mark, of any lake, river, stream, channel or other body of public water shall not be counted in the calculations for determining the maximum density for a subdivision. For example, if a forty (40) acre parcel in the R-5 zoning district contains thirty (30) acres submerged under Lake Pend Oreille's artificial high water mark, then the parcel contains ten (10) "usable" acres for the purpose of determining the maximum density in a subdivision. (Ord. 501, 11-18-2008) d. The division shall be designed around identified natural hazards (highly erosive soils on steep slopes, landslide areas, rock falls, areas of subsidence, floodplains) to protect building sites and roads from damage from such hazards. e. All plats shall include the sanitary restriction or the sanitary restriction lift per Idaho Code 50-1326. f. The lot size minimum shall be appropriate for the zone in which the division is located g. Resulting lots shall not be divided by boundary of any city, county, zoning designation, railroad right of way, or public right of way. (Ord. 557, 11-10-2016) 3. MLD Plat: The legal descriptions and MLD plat shall be prepared by an Idaho State registered land surveyor and shall include the plat certifications, descriptions, approvals and comments as set forth in sections 12-646, 12-647 and 12-649 of this chapter. 12-661: ADMINISTRATIVE REVIEW OF MINOR LAND DIVISION: Upon receipt and review of completeness, the planning and zoning department shall: A. Review the MLD plat and supplemental information to determine compliance with these ordinances and prepare its report, which shall include comments received from other departments. B. istribute the application to the county surveyor, the Assessor, the road and bridge department, GIS and floodplain administrator for review and compliance. C. Based on the above findings, the planning director shall approve, conditionally approve, or deny the application within thirty (30) days, from the date a completed application was stamped received. D. Once the director has made a recommendation, the MLD plat map and the legal descriptions shall be signed as approved and transmitted to the board of county commissioners at the next business meeting for review and possible approval. On behalf of the Bulldog Nation I would like to express my appreciation and thanks to the city of Sandpoint council members, Deb Ruehle, John Darling and Thomas Eddy for voting for the Greenplay recommendation which was also the recommendation of staff. That recommendation was to redesign Memorial Field to accommodate much needed additional parking, the addition of a softball field, keeping the baseball field and football field and installing artificial turf. Unfortunately three council members did not join them. The no votes asked questions that indicated that they were unfamiliar with the last four years of discussion. It also sounded like they did not read the packet provided by staff. That was disappointing. The result was a tie vote.

I have been thinking these past few weeks about someone I met nearly 10 years ago that I have never forgotten. Her name was Beth Hill. She impacted my life in ways that I can’t quite explain. I served as a Hospice chaplain for seven years and Beth was one of my patients. She loved the Lord and we would sit and talk about our faith, our family and how God had blessed our lives over the years. Beth knew she was dying, although her family did their best to keep that fact from her. She longed to leave this earth and go and be with Jesus. One particular day, a dark day for Beth, she told me she just wanted to die. She was tired, she hurt, she had lost her sight and was ready for heaven.

Update on a couple of Priest River old-timers. Annie and I were in a store in Spokane the other day, and low and behold, who did we run into, none other than John and Helen Delay. John was the former druggist in Priest River and Newport. He is now 97 and Helen is 94. John even still drives around his area. They live in a “cottage,” like the cottages that I have in Priest River. They both are still sharp and doing good for their ages. I remember years ago going on some mountain lake fishing trips with John ( nothing but good times.) And boy could he walk!! Would leave most people behind.

The first major documented polio outbreak in the U.S. occurred in Vermont in 1894 when eighteen deaths and 132 cases of permanent paralysis were reported. WBCSD election is tangled, tumultuous mess

The WBCSD #83 trustee election on November 5 is proving to be a tangled mess. Evidently, the county has been using a school zone map that is different than the one the school board wants to use. In 2010, the school board revised the school zone boundaries. According to Idaho Code 33-313, Section 5 when this happens these changes “... shall be filed by the school district with the county clerk.” A check with our county clerk confirmed the county never received this information from the school district. This means that in every election since then, some candidates have received votes from electors not in their school zone. The reason this is so critical is that in the last election the Zone 5 candidate won by a recount of only two votes, and Zone 5 is one of the zones changed nine years ago.

I was horrified; what was going on in this place? And who was this mayor who was courageous enough to want to try and unite the clearly divided community I had chosen to become a part of?

Since then, supplemental levy amounts have risen steadily, often dramatically. Last March was a 49% increase over the previous levy at a staggering $12.7 million per year. Every season flu sickens millions of Americans, hospitalizes hundreds of thousands, and kills tens of thousands. The 2017-2018 flu season was the most severe in a decade. While only moderate in severity, the 2018-2019 season was record-breaking in duration, with flu activity remaining elevated for 21 weeks. The U.S. had two different waves of flu, the first caused by H1N1 viruses and the second caused by H3N2 viruses.

Good public school are essential for the economic health of our community and for the future of our children. One of the first questions people ask about this area before moving here or moving their company here is, “How are the schools?” One reason we have been able to maintain excellent schools is because of the community support for supplemental levies. The vast majority of school districts in Idaho depend on these levies to make up for the shortfall in state funding. While levies have been sup-ported and approved here for the past 18 years, some do not support them because the levies do raise property taxes. The question whether or not we need the current levy was decided last March. Now the issue is can we make that levy permanent (no increase).

During election time, those of us who live outside of the city watch in hopes of seeing fresh leadership that will continue to improve and revitalize Sandpoint. Many of us tend to avoid the town because it seems so misguided. Visitors to the area just see a cute little town — and that it is. Locals, however, know about the streets that are barely functional, and businesses that are treated as an extension of local government to raise money to make up for poor budgeting and planning. The empty storefronts say, “This is not a business friendly town.” As beautiful as some of the artwork is, the amount of it shows misplaced priorities.

Making the case for a permanent school levy

Good public school are essential for the economic health of our community and for the future of our children. One of the first questions people ask about this area before moving here or moving their company here is, “How are the schools?” One reason we have been able to maintain excellent schools is because of the community support for supplemental levies. The vast majority of school districts in Idaho depend on these levies to make up for the shortfall in state funding. While levies have been sup-ported and approved here for the past 18 years, some do not support them because the levies do raise property taxes. The question whether or not we need the current levy was decided last March. Now the issue is can we make that levy permanent (no increase).

This is in support of the amount that was approved last March. The “Blanket Exercise” is an interactive learning experience that teaches the Indigenous rights history rarely mentioned in American history. It presents education on American-Indigenous history as one of the key steps to reconciliation covering over 500 years of history. Participants take on the roles of Native Americans standing on blankets that represent the land. They walk through pre-contact, treaty-making, colonization and resistance. The script is read by a Narrator and three-people representing the voices of Native Americans, European colonizers and Western Historians. Participants are drawn into the experience given cards of various colors which ultimately determine their outcomes. By engaging on an emotional and intellectual level, the Blanket Exercise effectively educates and increases understanding. This is followed by a debriefing time in groups then in a Talking Circle of all participants.

FOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF INTERNET FACILITIES WITHIN THE CITY OF EAST HOPE CITY OF EAST HOPE, COUNTY OF BONNER In the Matter of the Application of WIRED OR WIRELESS, INC. dba Air-Pipe (hereinafter referred to as "Grantee") for a franchise to locate, construct, operate and maintain poles, wires, underground cables and appurtenances over, under along and across road rights of way and public properties herein mentioned for the purpose of transmitting and distributing internet services, with the City of East Hope, State of Idaho (hereinafter referred to as "Grantor" or the "City") allowing them to construct, erect, operate, repair, replace, reconstruct and maintain poles, wires, coaxial and other cables, underground conduits, vaults, ducts, amplifiers, appliances, attachments and such other conductors and fixtures necessary for the proper maintenance and operation of a cable internet system; over, under, along and across all of Grantor's rights of way and public property in the City of East Hope, State of Idaho; and WHEREAS, Grantee is engaged in the business of providing internet services to customers consistent with applicable laws and regulations, and Grantor has determined it is in the interest of persons and businesses in this jurisdiction to have access to Grantee's services; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF EAST HOPE, BONNER COUNTY, IDAHO, that Wired or Wireless, Inc. dba Air-Pipe, its successors and assigns, is hereby granted a Franchise for the purposes identified below and subject to the following terms and conditions: 1. GRANT Grantor hereby grants to Grantee, its successors and assigns, the right, power, privilege and authority to enter upon all public roads, rights of way, streets, alleys, public places or structures lying within the boundaries of Grantor and owned or maintained by Grantor, to locate, construct, operate, maintain, repair, and replace poles, wires, underground cables and all necessary or desirable appurtenances for the purpose of transmitting and distributing internet services. This Franchise shall allow for the placement of such facilities as may be necessary to provide or enhance service within the City and surrounding areas. 2. TERM The rights, privileges and franchise hereby granted to, and conferred upon the Grantee shall, unless this Franchise be sooner terminated as herein provided, extend for a term of 10 (TEN) years from the date of written acceptance hereof by the Grantee with the Grantee reviewing franchise agreement each year. 3. STANDARDS OF SERVICE TRIMMING/REMOVAL OF TREES. The right of Grantee to maintain its lines, facilities and appurtenances shall include the right, to cut, trim or remove any and all trees, brush or shrubs growing in, on, or hanging over any City roads, rights of way, streets, alleys or City property that interfere with or may interfere with Grantee's installations, including wires, poles, conduits or other apparatus of Grantee, its successors and assigns. However, such trimming or removal of trees shall comply with municipal ordinances and policies regarding the City's trees as may now exist or hereafter be adopted. RIGHT OF EXCAVATION. For the purpose of carrying into effect the privileges granted hereunder, Grantee is authorized at any time upon issuance and receipt of an encroachment permit approved by the City to make all necessary excavations in the public streets, alleys, roads, rights of way and public grounds within the franchised area, but such excavation shall be carried out with reasonable dispatch and with as little interference with or inconvenience to the rights of the public as may be feasible. Grantee shall restore all streets, alleys, roads, rights of way and public grounds to their original condition within five (5) working days. In case any obstruction caused by Grantee shall remain longer than five (5) days, or in case of neglect by Grantee to safeguard any dangerous places, Grantor may remove such obstruction or safeguard such dangerous places at the expense of the Grantee. When making such excavations grantee will comply with municipal ordinance or policies, including but not limited to, excavation and encroachment in public right of way, storm water, grading and street cut policies. Grantee further agrees to warrant the right of way repair for one year from the completion of the repair. CONDITIONS OF STREET OCCUPANCY. All transmission and distribution structures, poles, other lines and equipment installed or erected by Grantee pursuant to the terms hereof shall be located so as to cause minimum of interference with the proper use of Public Ways and with the rights and reasonable convenience of property owners who own property that adjoins any of such public ways. RESTORATION OF PUBLIC WAYS. If during the course of Grantee's construction, operation, or maintenance of the system there occurs a disturbance of any Public Way by Grantee, it shall, at its expense, replace and restore such Public Way to a condition reasonably comparable to the condition of the Public Way existing immediately prior to such disturbance. 4. NON-INTERFERENCE WITH EXISTING FACILITIES All construction, installation, repair or relocation of lines and appurtenances performed by Grantee along or under the roads, rights of way or properties subject to this Franchise shall be done in such a manner as not to interfere with the construction and maintenance of other utilities, public or private, drains, drainage ditches and structures, irrigation ditches and structures located therein, nor with the grading or improvement of such roads, rights of way or other public property subject to this Franchise. 5. NECESSARY CONSTRUCTION MAINTENANCE BY GRANTOR The laying, construction, operation and maintenance of Grantee's lines and appurtenances authorized by this Franchise shall not preclude the Grantor, its agents or its contractors, from blasting, grading, excavating, or doing other necessary road work contiguous to the said lines and facilities of Grantee, provided that Grantee shall be given not less than five (5) days' notice of said blasting or other work, and provided further that the Grantor, its agents and contractors shall be liable for any damages, including any consequential damages to third parties, proximately caused by said work to any installations belonging to Grantee. 6. CONDUCT OF GRANTEE'S BUSINESS In carrying out the authorized activities under the privileges granted herein, Grantee shall meet accepted industry standards and comply with all applicable laws of any governmental entity with jurisdiction over its operations. Service shall be supplied to the Grantor and its inhabitants in accordance with the Grantee's rules and regulations and tariffs filed or hereafter filed with the appropriate regulatory body of this State having jurisdiction over the Grantee. 7. RIGHTS OF INGRESS/EGRESS To the extent permitted by law, the Grantee, its agents and employees, shall have the right and power of ingress and egress upon its customers' properties for the purpose of installing, servicing and maintaining its facilities, including the testing and reading of service meters. 8. VACATION OF PROPERTIES BY GRANTOR If, at any time, the Grantor shall vacate any road, right of way or other public property which is subject to rights granted by this Franchise, such vacation shall be Subject to the reservation of a perpetual easement in favor of Grantee for the purpose of operating and maintaining facilities lines as is set forth in Idaho Code section 50-311. 9. RELOCATION OF FACILITIES Grantor shall notify Grantee of any intended or expected requirement or request by the city to relocate Grantee's facilities as early as practicable, but not later than 90 days prior to any such relocation when the requirement or request could have been foreseen by that date. Grantor shall endeavor to cause any such relocation to be consistent with any applicable long-term development plan or projection of Grantor or approved by Grantor. If, at any time, the Grantor shall cause or require the alteration or the improvement (the "Improvement") of any sidewalk, bike path, bike pedestrian path, road, highway, right-of-way or right of way appurtenance wherein Grantee maintains facilities subject to this franchise for any purpose including but not limited to grading or regrading, planking or paving the same, changing the grade, altering, changing, constructing, repairing or relocating the same or by constructing drainage or sanitary sewer facilities, the Grantee upon written notice from the Grantor shall, with all convenient speed at Grantee's sole cost, change the location or readjust the elevation of its system including, but not limited to poles and underground facilities and other facilities so that the same shall not interfere with such work and so that such equipment and facilities shall conform to such new grades, routes or other modifications as may be established. The relocation of Grantee's facilities shall be at the sole expense of Grantee unless: (i) Grantor shall require Grantee to adapt or conform its systems, or any part thereof, or to in anyway alter, relocate or change its property to enable any other person, firm, corporation or entity (whether public or private), other than Grantor, to use the public ways. Grantee shall be entitled to reimbursement from the person, firm, corporation or entity desiring or occasioning such change, alteration or relocation. 10. PRESERVATION OF GRANTOR'S RIGHTS TO CONTROL The Grantor, in granting this Franchise, does not waive any rights which it may now have or may hereafter acquire with respect to road rights of way or other property of Grantor under this Franchise, and this Franchise shall not be construed to deprive the Grantor of any such powers, rights or privileges which it now has or may hereafter acquire to regulate the use of and to control the Grantor's roads, rights of way and other public property covered by this Franchise. 11. EMERGENCY REMOVAL BY GRANTOR The Grantor reserves the right to remove any such wires, poles, or apparatus ("Grantee's facilities) herein provided for in case of general conflagration or in other cases of extreme emergency where there is neither the time nor the opportunity for Grantee to perform such work. Grantor shall use reasonable care in the exercise of such emergency powers. Grantor shall indemnify and hold harmless the Grantee, its successors and assigns, against any and all property damage, personal injury, death, or other liability to third parties sustained as a result of the negligent exercise of such reserved emergency powers, and shall at its expense, restore Grantee's facilities removed as a result of such exercise. 12. NON-EXCLUSIVE FRANCHISE This Franchise shall not be deemed to be an exclusive Franchise. It shall in no manner prohibit the Grantor from granting other franchises of a like nature or franchises to other public or private utilities under, along, across, over and upon any of Grantor's roads, rights of way or other property of Grantor subject to this Franchise and shall in no way prevent or prohibit the Grantor from constructing, altering, maintaining or using any of said roads, rights of way, drainage structures or facilities, irrigation structures or facilities, or any other property of Grantor or affect its jurisdiction over such property to make all necessary changes, relocations, repairs, maintenance, etc., insofar as the Grantor may deem fit. 13. FORFEITURE If Grantee shall willfully violate or fail to comply with any of the provisions of this Franchise through willful and unreasonable neglect or willful and unreasonable failure to heed or comply with any notice given Grantee under the provisions of this grant, then Grantee shall forfeit all rights conferred hereunder and this Franchise may be revoked or annulled by the Grantor; provided, however, the Grantor shall give ninety (90) days' written notice of its intention to revoke or annul the Franchise during which period Grantee shall have the opportunity to remedy any breach. 14. EXPANSION OF GRANTEE'S FACILITIES Any facilities and appurtenances in streets, alleys, rights of way and public places, incidental to the franchise system, that have been, or are at any future time acquired, leased, or utilized in any manner by Grantee are there upon to be deemed authorized by and shall be subject to all provisions of this Franchise. 15. CHANGE OF BOUNDARIES OF GRANTOR Any subsequent additions or modifications of the boundaries of the Grantor, whether by annexation, consolidation or otherwise, to the extent permitted by law shall be subject to the provisions of this Franchise as to all such areas. Grantor shall notify Grantee of the precise scope of any change of boundaries and upon request provide Grantee current City maps reflecting changes to annexation. 16. PRIOR FRANCHISES SUPERSEDED This Franchise shall update and supersede all prior franchises heretofore granted to GMS Cable or Wired or Wireless, Inc. or their predecessors, by Grantor, or its predecessors, and shall affirm, authorize and ratify all prior installations authorized by permits or other action not previously covered by this Franchise. 17. ASSIGNMENT OF FRANCHISE Grantee, its successors and assigns, may not sell, transfer, or assign this franchise without the express written consent of the City of East Hope. All provisions, conditions, regulations and requirements herein contained shall be binding upon and inure to the benefit of the successors and assigns of the parties hereto. 18. EFFECT OF INVALIDITY The Franchise is granted pursuant to the laws of the state of Grantor relating to the granting of such rights and privileges by Grantor. If any article, section, sentence, clause, or phrase of this Franchise is for any reason held illegal, invalid, or unconstitutional, such invalidity shall not affect the validity of the Franchise or any of the remaining portions. The invalidity of any portion of this Franchise shall not abate, reduce, or otherwise affect any obligation required of Grantee. 19. FRANCHISE AS CONTRACT This Franchise shall have the effect of and shall be a contract between Grantor and Grantee and shall be the measure of the rights and liabilities of the Grantor as well as of Grantee. 20. EQUALITY OF FRANCHISE FEES AND COSTS Grantor shall assess a franchise fee of $500.00 per year. The franchise fee shall be paid by the Grantee to the Grantor within thirty (30) days of the end of each fiscal year (September 30th). The franchise fee paid by the Grantee will be in lieu of fees imposed by Grantor on Grantee in connection with issuance, maintenance, existence, continuation, or use of the franchise or the public rights of way governed hereby, granted pursuant to this document. 21. INSURANCE, and INDEMNIFICATION Insurance Requirements. Grantee shall maintain in full force and effect during the term of the Franchise, at its own cost and expense, Comprehensive General Liability Insurance in the amount of $1,000,000. Such insurance shall designate Grantor as an additional insured and provide proof to Grantor. Indemnification. Grantee agrees to indemnify, save and hold harmless, and defend Grantor, its officers, board members and employees, from and against any liability for damages and for any liability or claims resulting from property damage or bodily injury (including accidental death) which arise out of Grantee's construction, operation or maintenance of its system, including, but not limited to, reasonable attorneys' fees and costs. 22. ABANDONMENT OF FRANCHISE Grantee may at any time abandon the rights and authorities granted hereunder, provided that six (6) months' written notice of intention to abandon is given to Grantor. 23. MISCELLANEOUS The Grantee shall assume the cost of publication of this Franchise and the ordinance implementing the Franchise if passed by the City, as required by law. A bill for publication costs shall be presented to the Grantee by the City Clerk upon the Grantee's filing of acceptance and shall be paid at the time. 24. ACCEPTANCE OF FRANCHISE Grantee shall notify Grantor in writing of its acceptance of this Franchise within thirty (30) days of the approval of this Franchise by Grantor.
