TRUSTEE'S SALE

On the 29th day of July, 2004, at the hour of 10:00 A.M., of said day, (recognized local time), in the Office of First American Title Company, 419 Second Ave., Sandpoint, in the County of Bonner, State of Idaho.

First American Title Company of Idaho, Inc., an Idaho Corporation, as successor trustee, will sell at public auction, to the highest bidder, for certified funds, or the equivalent, which is lawful money of the United States of America, all payable at the time of sale in compliance with Section 45-1506(9) Idaho Code, the following described real property, situated in the County of Bonner, State of Idaho, and described as follows, to-wit:

A tract of land located in the Southwest quarter of the Northeast quarter of Section 18, Township 56 North, Range 5 West, Boise Meridian, Bonner County, Idaho, more particularly described as follows: Said tract being the North half of the Northwest quarter of the Southwest quarter of the Northeast quarter of said Section 18. EXCEPT right of way for Freeman Lake Road, a county road.

This Trustee's Sale is subject to any bankruptcy filing, payoff, reinstatement, or any other conditions of which the Trustee is not aware of, and that would cause the cancellation of this sale. Further, if any of these conditions exist, this sale may be null and void. The successful bidder's funds shall be returned, and the Trustee and/or the Beneficiary shall not be held liable to any successful purchaser(s) or bidders, at the Trustee's Sale, for any damages.

The Trustee has no knowledge of a more particular description of the above referenced real property, but for purposes of compliance with Section 60-113 Idaho Code, the Trustee has been informed that according to the County Assessors office, the address of 3649 Freeman Lake Road, Oldtown, Idaho, is sometimes associated with said real property.

Said sale will be made without covenant or warranty regarding title, possession or encumbrances to satisfy the obligation secured by and pursuant to the power of sale conferred in the deed of trust executed by BILLY JOE JAMISON AND SUSAN L JAMISON, husband and wife, as grantors, to FIRST AMERICAN TITLE COMPANY OF IDAHO, INC., an Idaho Corporation, as successor trustee, for the benefit and security of Fleet National Bank, as beneficiary, recorded November 17, 2000, as Instrument No. 573004, and assigned to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., (solely as nominee for Lender, and Lender's successors and assigns), as beneficiary by assignment recorded September 11, 2002, as Instrument No. 608407, Mortgage Records of Bonner County, Idaho.

THE ABOVE GRANTORS ARE NAMED TO COMPLY WITH SECTION 45-1506 (4)(A), IDAHO CODE. NO REPRESENTATION IS MADE THAT THEY ARE, OR ARE NOT, PRESENTLY RESPONSIBLE FOR THIS OBLIGATION.

The default for which this sale is to be made is the failure to pay when due, under Deed of Trust Note, the monthly payments for Principal, Interest and Impounds of $953.16, due per month for the months of November, December, 2003 and January, 2004 and all subsequent payments until the date of sale or reinstatement, with a monthly late charge accruing at $34.93, with interest accruing at 8% per annum, and continuing to accrue from October 1, 2003. The principal balance owing as of this date on the obligation secured by said Deed of Trust is $115,906.27, plus accruing interest, costs and advances. All delinquent amounts are now due, together with accruing late charges and interest, unpaid and accruing taxes, assessments, trustee's fees, attorney's fees, and any amounts advanced to protect the security associated with this foreclosure and that the beneficiary elects to sell or cause the trust property to be sold to satisfy said obligation.
