TRUSTEE'S SALE

NOTICE IS HEREBY GIVEN that, at 10:00 o'clock a.m. on November 1st, at the Law of Tevis W. Hull, 123 South 3rd Ave., Suite 2, Sandpoint, Idaho a sale of certain real property hereinafter described, secured by a Deed of Trust, shall be sold to satisfy an obligation in default. The Trustee shall sell the property at auction to the highest bidder for cash, in lawful money of the united States, payable at the time of sale. No covenant, warranty or guarantee shall be made to any purchaser as to title, possession or encumbrances.

The real property subject to the Deed of Trust is situated in the State of IDAHO, County of BONNER, and is described as:

Lot 4, Block 2, in ALGOMA ADDITION, according to the plat thereof, recorded in Book 3 of Plats, Page 163, records of Bonner County, Idaho.

The sale is pursuant to the power of sale granted by DAVID A. BOGER, Grantor, in a Deed of Trust dated November 4, 2002, recorded on November 6, 2003 as Instrument number 611972, naming ARNOLD BENDA, as Beneficiary. The Deed of Trust was recorded in BONNER COUNTY, IDAHO. Sandpoint Title Insurance has resigned as Trustee, recorded as Instrument number 634091, and the Beneficiary has appointed Tevis W. Hull as Trustee of the aforementioned Deed of Trust.

The Deed of Trust was transferred to secure DAVID A. BOGER's payment of Forty-four Thousand Dollars ($44,000.00) with a final payment date of March 4, 2020 to ARNOLD BENDA. DAVID A. BOGER has breached the obligation for which the Deed of Trust was given as security. The nature of the breach is DAVID A. BOGER's failure to make regular monthly payments. All of these named sums, plus attorney fees and costs related to the foreclosure of the Deed of Trust and accrued interest are now due and payable.

The Trustee of the Deed of Trust, Tevis W. Hull, at the instruction of the Beneficiary, has elected to cause to be sold the above-described property as a result of DAVID A. BOGER's breach. Such sale shall be conducted so as to satisfy the secured obligation owed to ARNOLD BENDA.

The sum owing on the default obligation is Forty-three Thousand Nine Hundred Ninety-one Dollars and 48/100 ($43,991.48) outstanding principal amount as of March 4, 2003 together with the interest thereon at Eleven percent (11%) per annum, plus outstanding taxes, penalties and interest, plus outstanding escrow fees, plus attorney fees and costs related to the foreclosure of the Deed of Trust and accrued interest.
