TRUSTEE'S SALE

On the 5th day of October, 2004, at the hour of 10:00 A.M., of said day, (recognized local time), in the Office of First American Title Company, 419 Second Ave., Sandpoint, in the County of Bonner, State of Idaho.

First American Title Company of Idaho, Inc., an Idaho Corporation, as successor trustee, will sell at public auction, to the highest bidder, for cash or cashiers check (cash equivalent), in lawful money of the United States, all payable at the time of sale in compliance with Section 45-1506(9) Idaho Code, the following described real property, situated in the County of Bonner, State of Idaho, and described as follows, to-wit:

The South half of the Southwest quarter of the Southeast quarter of Section 5, Township 55 North, Range 5 West, Boise Meridian, Bonner County, Idaho;

LESS the County Road.

The Trustee has no knowledge of a more particular description of the above referenced real property, but for purposes of compliance with Section 60-113 Idaho Code, the Trustee has been informed that according to the County Assessors office, the address of 2395 HonDoo Loop Road, Old Town, Idaho, is sometimes associated with said real property.

Said sale will be made without covenant or warranty regarding title, possession or encumbrances to satisfy the obligation secured by and pursuant to the power of sale conferred in the deed of trust executed by MARK L JOHNSON AND BETTY L JOHNSON, husband and wife, as grantors, to FIRST AMERICAN TITLE COMPANY OF IDAHO, INC., an Idaho Corporation, as successor trustee, for the benefit and security of Washington Mutual Home Loans, Inc., as beneficiary, recorded August 27, 2001, as Instrument No. 586844, and assigned to FEDERAL NATIONAL MORTGAGE ASSOCIATION, as beneficiary, by assignment recorded November 20, 2003, as Instrument No. 639182, Mortgage Records of Bonner County, Idaho.

THE ABOVE GRANTORS ARE NAMED TO COMPLY WITH SECTION 45-1506(4)(A), IDAHO CODE. NO REPRESENTATION IS MADE THAT THEY ARE, OR ARE NOT, PRESENTLY RESPONSIBLE FOR THIS OBLIGATION.

The default for which this sale is to be made is the failure to pay when due, under Deed of Trust Note, the monthly payments for Principal, Interest and Impounds of $1,771.46, due per month for the months of July through September, 2003 and all subsequent payments until the date of sale or reinstatement, with a monthly late charge accruing at $78.87, uncollected late charges are due in the amount of $236.61, with interest accruing at 7.5% per annum, and continuing to accrue from June 1, 2003. The principal balance owing as of this date on the obligation secured by said Deed of Trust is $221,834.02, plus accruing interest, costs and advances. All delinquent amounts are now due, together with accruing late charges and interest, unpaid and accruing taxes, assessments, trustee's fees, attorney's fees, and any amounts advanced to protect the security associated with this foreclosure and that the beneficiary elects to sell or cause the trust property to be sold to satisfy said obligation.

On 12/10/04, at 11:00 A.M. of said day, at the front entrance of First American Title Co., 419 N. 2nd., Sandpoint, ID 83864, First American Title Insurance Company, as Successor Trustee, will sell at public auction to the highest bidder, for cash, in lawful money of the United States, all payable at the time of sale, the following described real property, situated in the County of Bonner, State of Idaho, and described as follows to wit: The South Half of the Northeast Quarter of the Southeast Quarter of the Northeast Quarter of Section 31, Township 56 North, Range 5 West, Boise Meridian, Bonner County, Idaho; excepting therefrom the County road right of way along the East line thereof.

Evans and Cheryl M. Evans, as Grantors, to Sandpoint Title Insurance, Inc., Trustee, and Headlands Mortgage Company, as the Beneficiary, on a Deed of Trust Recorded on September 27, 1996 as Document No. 1996 492502 in the records of Bonner County, Idaho. The above Grantors are named to comply with Section 45-1506(4)(a), Idaho Code. No representation is made that they are, or are not, presently responsible for this obligation. The default for which this sale is to be made is the failure to pay the amount due under the certain Promissory Note and Deed of Trust, in the amounts called for thereunder as follows: Monthly payments in the amount of $58,186.85 for the months of February 1, 2004 and all subsequent monthly payments, late charges, and advances accruing after the date of this document. The sum owing on the obligation secured by said Deed of Trust is $58,186.85 as principal, plus services charges, attorney's fees, costs of this foreclosure, and any and all funds expended by said Beneficiary to protect its security interest, and interest accruing at the rate of 8.00% from 02/01/2004 to the date of sale herein described. The Beneficiary elects to sell or cause the trust property to be sold to satisfy said obligation.
