TRUSTEE'S SALE

NOTICE IS HEREBY GIVEN that on September 9, 2004, at 11:00 a.m. the office of Catherine L. Dullea, Attorney at Law, as Successor Trustee, 101 N. Fourth Avenue Suite 204, Sandpoint, ID, will sell at public auction to the highest bidder, for cash in lawful money of the United States of America, all payable at the time of sale, the following real property situated in the County of Bonner, State of Idaho, described as follows:

A tract of land located in the Southwest Quarter of the Northwest Quarter of Section 30, Township 56 North, Range 3 West, Boise Meridian, Bonner County, Idaho, more fully described as follows:

Beginning at an iron pipe located in the South right of way fence of the county road, said point being North a distance of 3,923 feet;

Thence East a distance of 717 feet from the Southwest corner of said Section 30;

Thence South 17°28 1/2 West a distance of 279.9 feet to an iron pipe;

Thence North 57°39 1/2 West a distance of 162.1 feet to an iron pipe;

Thence North 29°46 3/4 East a distance of 95.9 feet to an iron pipe;

Thence North 65°16 1/2 West a distance of 61.2 feet to an iron pipe;

Thence North 6°39 1/2 West a distance of 73.7 feet to an iron pipe in said South right of way;

Thence along said South right of way of South 89°33 1/2 East a distance of 237.5 feet to the point of beginning.

Except any part thereof lying within Book 22 of Deeds, Page 33 for road right of way.

Said sale will be made, without covenant or warranty regarding title, possession or encumbrances, to satisfy the obligations secured by and pursuant to the power of sale conferred in the Deed of Trust executed by JARED RIGGS and KIMBERLY A. RIGGS, husband and wife, as Grantors to Sandpoint Title Insurance, as Trustee, and said Trustee having resigned and the Beneficiaries having appointed Catherine L. Dullea, Attorney at Law, as Successor Trustee, for the benefit and security of G. HENRY MIRE and PAULINE MIRE, husband and wife, as Beneficiaries, said Deed of Trust having been recorded on October 9, 2002, as Instrument No. 610376, official records of Bonner County, Idaho.

THE ABOVE GRANTORS ARE NAMED TO COMPLY WITH S45-1506(4)(a) IDAHO CODE. NO REPRESENTATION IS MADE THAT THEY ARE, OR ARE NOT, PRESENTLY RESPONSIBLE FOR THIS OBLIGATION.

The default for which the sale is to be made is the failure of the Grantors and/or assumptive Grantor(s) to make monthly payments in a sum sufficient to bring interest current for the months of January, February, March and April, 2004, failure to pay late fees in the sum of 10.0% of the payment amount due for same months, failure to pay monthly escrow reserve account payments of $78.00, each, for the same months, failure to pay insurance on the property, which the Beneficiaries have paid in the sum of $273.00, and failure to pay default and attorney fees in the sum of $200.00.

The balance owing as of the date hereof on the obligation secured by said Deed of Trust is the amount of $64,763.45, plus accrued interest at the rate of 12.0% per annum from December 7, 2003, plus any other costs or expenses associated with this obligation or foreclosure as provided by the Deed of Trust or Deed of Trust Note or by Idaho law.
