RESCHEDULED NOTICE OF TRUSTEE'S SALE
Pursuant to Idaho Code Section 45-1506A On April 26, 2005, at 11:00AM of said day, at the front entrance of First American Title Co., 419 N. 2nd, Sandpoint, ID 83864, First American Title Insurance Company, as Successor Trustee, will sell at public auction to the highest bidder, for cash, in lawful money of the United States, all payable at the time of sale, the following described real property, situated in the County of Bonner, State of Idaho, and described as follows to wit: Lot 1 of Block 4 of Cavanaugh Bay Airport Estates, according to the Plat thereof, recorded in Book 5 of Plats, Page 81, Records of Bonner County, Idaho. Parcel No. RP 053010040010 A The Trustee has no knowledge of a more particular description of the above referenced real property, but for purposes of compliance with Section 60-113 Idaho Code, the Trustee has been informed the address of 24 Loy Road, Coolin, ID 83821, is sometimes associated with the said real property. Said sale will be made without covenant or warranty regarding title, possession or encumbrances to satisfy the obligation secured by and pursuant to the power of sale conferred in the Deed of Trust executed by Cynthia Ann Dresser, as Grantors, to Alliance Title & Escrow, Trustee, and Mortgage Electronic Registrations Systems, Inc., solely as nominee for Greenpoint Mortgage Funding, Inc., as the Beneficiary, on a Deed of Trust Recorded on March 13, 2002 as Document No. 597819 in the records of Bonner County, Idaho. The above Grantors are named to comply with Section 45-1506(4)(a), Idaho Code. No representation is made that they are, or are not, presently responsible for this obligation. The default for which this sale is to be made is the failure to pay the amount due under the certain Promissory Note and Deed of Trust, in the amounts called for thereunder as follows: Monthly payments in the amount of $1,294.16 for the months of May 1, 2004 to July 1, 2004 when the payment adjusted to $1,309.77 and all subsequent monthly payments, late charges, and advances accruing after the date of this document. The sum owing on the obligation secured by said Deed of Trust is $154,456.76 as principal, plus services charges, attorney's fees, costs of this foreclosure, and any and all funds expended by said Beneficiary to protect its security interest, and interest accruing at the rate of 7.750% from April 1, 2004 to the date of sale herein described. The Original Notice of Trustee's Sale given pursuant thereto stated that the property would be sold on 12/03/04 at the hour of 11:00 a.m., at the front entrance of First American Title Co., 419 N. 2nd, Sandpoint, ID 83864; however, subsequent to the recording of said Notice of Default, the original sale proceedings were stayed by order of the Court of by proceedings under the National Bankruptcy Act or for other lawful reasons. the beneficiary did not participate in obtaining such stay. Said stay was terminated on March 7, 2005. The Beneficiary elects to sell or cause the trust property to be sold to satisfy said obligation.
