ORDINANCE NO. 4-30b
AN ORDINANCE OF THE CITY OF PONDERAY, BONNER COUNTY, IDAHO, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO; AMENDED PONDERAY MUNICIPAL CODE SECTION 2-306 TO PROVIDE FOR INCREASED RENEWAL FEES FOR LATE RE RENEWALS OF BUSINESS LICENSES; PROVIDING FOR PENALTIES; PROVIDING FOR AN EFFECTIVE DATE THEREOF; AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE.
WHEREAS, the Mayor and City Council of the City of Ponderay have determined that a number of businesses subject to Chapter 3, Title 2, Ponderay Municipal Code, fail or refuse to comply with the requirement to renew their business licenses in a timely manner, and that such failure or refusal results in increased costs to the City in identifying such businesses and attempting to enforce the provisions of the Chapter, ant that increased fees for businesses which do not timely renew their business licenses will encourage timely compliance and help offset the costs to the City with regard to those businesses which do not timely comply, and that such increased fees would be in the best interest of the City and its citizens;
Now, therefore,
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PONDERAY, BONNER COUNTY, IDAHO:
Section 1.00:
Ponderay Municipal Code S 2-305 is hereby amended as follows:
License Fees. (a) Every individual or entity required by this Chapter to obtain a license to engage in any business, trade or profession shall pay to the City Clerk a fee upon the initial licensing of the business and an annual renewal fee which fees shall be set, from time to time, by resolution of the City Council. Said fee must be paid in full prior to the issuance or endorsement of a business license. There shall be no proration of said fee for individuals or entities which engage business, trades or professions for a period of less than the license year.
(b) The City Council, in its resolution setting fees, may but is not required to, set different renewal fees based on the actual date of renewal, including higher renewal fees for late renewal.
Section 2.00:
Ponderay Municipal Code S 2-306 is hereby amended as follows:
Expiration of Business License; Renewal; Grace Period. (a) All business licenses issued pursuant to this Chapter shall expire on December 31 of each year.
(b) Any person or entity who engages in a business, trade or profession within the City, and who holds a business license pursuant to this Chapter, shall renew said license on a form provided by the City and accompanied by the appropriate fee prior to January 31 of each year. No new application need be filed if the information required by this Chapter, and which is in the possession of the City Clerk, is current. Upon receipt of the form and fee, the City Clerk shall endorse the business license for the person or entity for the next calendar year.
(c) The City Clerk shall cause notice of the required renewal and the appropriate fee, together with a renewal form, to be sent to each business no later than December 1 of each year to the business address listed in the City records. If a business license is not renewed by January 31, the City Clerk shall cause a second notice of the required renewal and the appropriate fee, together with a renewal form, to be sent to such business. If the business license is not renewed in the time provided by the second notice, the City Clerk shall cause successive notices to be sent to the business for each level of renewal fee set by resolution. PROVIDED, nothing herein shall relieve a business of renewing its business license as required by this section, whether it receives any notice or not.
Section 3.00: Effective Date; Publication.
This Ordinance shall be in full force and effect upon its passage, approval, and publication in one issue of the Bonner County Daily Bee, a newspaper of general circulation published in the City of Sandpoint and the official newspaper of the City of Ponderay and hereby declared to be the official newspaper for the publication of this Ordinance.
