SUMMONS

To: HUMBIRD LUMBER COMPANY, a corporation organized under and by virtue of the laws of the State of Washington and fully authorized to do business and own property in the State of Idaho, and doing business in the State of Idaho in the name of Humbird Lumber Company, Ltd.; and each unknown party, whose true is unknown, being an unknown owner, or an unknown heir or devisee of a deceased unknown owner, claiming any right, title or interest by virtue of the Warranty Deed, recorded on January 12, 1934, in Book 53 of Deeds, Page 366, as Instrument No. 84447, records of Bonner County, Idaho, in the following described real property:

A portion of Government Lot 3 and a portion of the East half of the Southwest Quarter of Section 19, Township 57 North, Range 4 West, Boise Meridian, Bonner County, Idaho, and being more particularly described as follows:

Commencing at the West quarter corner of said Section 19; thence along the East-West centerline of said Section 19; South 88o56'41" East, a distance of 683.56 feet to the True Point of Beginning; thence continuing along said East-West centerline of said Section 19, South 88o56'41" East a distance of 2139.06 feet to the center quarter corner of said Section 19; thence along the North-South centerline of said Section 19, South 00o51'22" West a distance of 184.40 feet to an intersection with the Northeasterly right of way of McAbee Falls Road as shown on plans for F.A.P.S.-5783(2), records of the Idaho Department of Transportation; thence along said Northeasterly right of way, South 51o15'45" West a distance of 827.38 feet; thence continuing along said Northeasterly right of way, along a curve to the left having a central angle of 07o50'45", a radius of 5754.58 feet, and a chord of South 47o20'23" for a distance of 787.40 feet; thence leaving said Northeasterly right of way, North 89o41'43" West a distance of 912.18 feet; thence North 00o01'45" East a distance of 1270.24 feet to the True Point of Beginning.

SUBJECT TO the right of the public in and to any and all easements and rights of way for any and all public roads now established or existing on said premises, or any part thereof, as reserved by Humbird Lumber Company, a corporation, in Deed recorded January 12, 1934 as Instrument No. 84447, in Book 53 of Deeds, Page 366, records of Bonner County, Idaho.

ALSO SUBJECT TO easements, conditions, restrictions, reservations, covenants and rights of way of record (referred to below collectively as the "defendants"):

You have been sued by WILLIAM P. LEMM, JR. and JULIA ANN F. LEMM, the Plaintiffs, in the District Court in and for Bonner County, Idaho Case No. CV-2005-00977.

The nature of the claim against you is quieting of title to the above-described real property, and a permanent injunction from asserting any claim therein.

Any time after 20 days following the last publication of this summons the court may enter a judgement against you without further notice, unless prior to that time you have filed a written response in the proper form, including the case number, and paid any required filing fee to the Clerk of the Court at 215 South First Avenue, Sandpoint, Idaho 83864, telephone number (208) 265-1432 and served a copy of your response on the Plaintiff's attorney at the office of Stephen F. Smith, Attorney at Law, Chartered, 120 Superior Street, P.O. Box C, Sandpoint, Idaho 83864, telephone number (208) 263-3115.
