Passing on the right is dangerous practice

In reference to Mike Auclair's letter, Daily Bee, July 31.

Idaho Code 49-702, PEDESTRIANS' RIGHT-OF-WAY IN CROSSWALKS, reads, in part, as follows:

(4) Whenever any vehicle is stopped at a marked crosswalk or at an unmarked crosswalk at an intersection to permit a pedestrian to cross the highway, the driver of any other vehicle approaching from the rear shall not overtake and pass the stopped vehicle.

Please note that a crosswalk does not have to be marked.

As far as the vehicle passing on the right is concerned, refer to Idaho Code 49-633.

49-633. WHEN PASSING ON THE RIGHT IS PERMITTED. (1) The driver of a vehicle may overtake and pass upon the right of another vehicle only under the following conditions:

(a) When the vehicle overtaken is making or about to make a left turn;

(b) Upon a highway with unobstructed pavement of sufficient width for two (2) or more lines of vehicles moving lawfully in the direction being traveled by the overtaking vehicle.

(2) The driver of a vehicle may overtake and pass another vehicle upon the right only under conditions permitting such movement in safety. That movement shall not be made by driving off the roadway.

The vehicle passing on the right was the one at fault. Every day you can see this in Sandpoint. They will even drive up on the sidewalk to pass on the right because they are in a hurry. It would help if the left-turning vehicles would stay in the middle of their lane rather than crowding to the left, inviting the following person to make an illegal pass.
