NOTICE OF

PUBLIC HEARING

Notice is hereby given that the Sandpoint City Council will hold separate public hearings at their regular meeting on Wednesday, December 21, 2005, at 5:30 p.m. in the council chambers at City Hall, 1123 Lake Street, Sandpoint, ID, to consider the following:

1. PUD05 / S05-05 - A request by Larry & June Toppenberg, Don & Joyce Tinseth, and Dale & Wanda Micetic for final Planned Unit Development and final subdivision approval to develop 41 lots on approximately 16 acres in the Residence "A" zone. The site is east of the Sandpoint Airport on the east side of Boyer Avenue and is located in the SW 1 / 4 of the NE 1 / 4 in Section 10, Township 57, Range 2 W.B.M. The Planning Commission has recommended approval of this application.

2. CP05-01 - A request by Bruce and Heather Pedersen to amend the Comprehensive Plan Map designation from Medium Density Residential to Business for an approximately 24,750 square foot parcel located at the intersection of Forest Avenue and Pine Street. The legal description of the property is Lots 16 through 24, Block 53, Westend Addition E to Sandpoint. The City has added lots 13, 14, and 15 to this request to maintain consistency in the south half of this block. The Planning Commission has recommended approval of this application.

3. ZC05-04 - A request by Bruce and Heather Pedersen for a zone change from Residence "B" to Professional Office "PO" for an approximately 24,750 square foot parcel located at the intersection of Forest Avenue and Pine Street. The Applicants have proposed a Development Agreement in conjunction with the request. The legal description of the property is Lots 16 through 24, Block 53, Westend Addition E to Sandpoint. The City has added lots 13, 14, and 15 to this request to maintain consistency in the south half of this block. The Planning Commission has recommended approval of this application for Lots 15 though 24 subject to a Development Agreement.

4. CP05-02 - The City of Sandpoint is initiating a Comprehensive Plan map amendment for various parcels as follows:

A) A map change from Low Density Residential to Industrial for property adjoining the Sandpoint Airport, located west of Boyer Avenue, north of Mountain View Drive, and east of the Airport. The property is described as the SE 1 / 4 of the SW 1 / 4 of Section 10, Township 57 North, Range 2 W.B.M., Less Lot 12 and Less the Airport. The Planning Commission has recommended approval of this parcel.

B) A map change from Low Density Residential to Industrial for property adjoining the Sandpoint Airport, located east of North Boyer Avenue, south of Schweitzer Cutoff Road, and west of the Airport. The property is described as the North 1 / 2 of NW 1 / 4 of the NE 1 / 4, and the NW 1 / 4 of the SW 1 / 4 of the NE 1 / 4, all west of the Airport in Section 10, Township 57 North, Range 2 W.B.M. The Planning Commission has recommended approval of the portion described as NW 1 / 4 of the SW 1 / 4 of the NE 1 / 4, west of the Airport west of the Airport in Section 10, Township 57 North, Range 2 W.B.M.

C) A map change from Low and Medium Density Residential to Industrial for property located west of Boyer Avenue, south and east of Culvers Drive. The property is described as Block 1 north of the railroad right-of-way, and Blocks 2 and 3 of Culver's Addition, and the Bombay subdivision. The Planning Commission has not recommended approval of this parcel.

D) A map change from Low Density Residential to Industrial for property located east of North Boyer Avenue and north of Woodland Drive. The property is described as Lots 2 and 3, and the South 1 / 2 of the NW 1 / 4 of the NW 1 / 4 lying east of the railroad right-of-way, in Section 10, Township 57 North, Range 2 W.B.M. The Planning Commission has recommended approval of this parcel.

E) A map change from Low Density Residential to Medium Density Residential for the Condo del Sol Condominium area. The site is located west of vacated Riverside Avenue and south of Superior Street off Iberian Way, and is generally described as Tax Nos. 11, 16, 19A, 19B, and 19C, in Sections 22 and 23, Township 57 North, Range 2 W.B.M. The properties are more commonly known as 108 and 110 Pacific Avenue and 301 Iberian Way. The Planning Commission has recommended approval of this parcel.

F) A map change from Rural to Low Density Residential for an approximately 10-acre parcel lying north of Schweitzer Cutoff Road between its intersection with Boyer Avenue and Sand Creek. The property is described as the SE 1 / 4 of the SW 1 / 4 of the SE 1 / 4 of Section 3, Township 57 North, Range 2 W.B.M., less the county road right-of- way along the south line thereof. The Planning Commission has recommended approval of this parcel.

5. ZC05-05 - The City of Sandpoint will consider a zone change from Residence "A" to Light Industrial "ER" for property adjoining, and including a portion of, the Sandpoint Airport as follows:

A) A parcel located west of Boyer Avenue, north of Mountain View Drive, east of the Airport, and described as the SE 1 / 4 of the SW 1 / 4 of Section 10, Township 57 North, Range 2 W.B.M., Less Lot 12 and Less the Airport. The Planning Commission has recommended approval of this parcel.

B) The City of Sandpoint will consider a zone change from Residence "A" to Light Industrial "ER" for property for east of North Boyer Avenue, west of Boyer Avenue, and south of Schweitzer Cutoff Road. The property is described as the West 1 / 2 of the NE 1 / 4, west of Boyer Avenue, less the subdivision known as Grand View Estates in Section 10, Township 57 North, Range 2 W.B.M. The Planning Commission has recommended approval of the portion described as the West 1 / 2 of the NE 1 / 4 , west of Boyer Avenue, less the subdivision known as Grand View Estates, and less the North 1 / 2 of the NW 1 / 4 of the NE 1 / 4 west of the Airport in Section 10, Township 57 North, Range 2 W.B.M.

6. ZC05-06 - The City of Sandpoint will consider an amendment to Section 9-3-7 of Sandpoint City Code to add "Airports" to the list of permitted uses in the Light Industrial "ER" zone. The Planning Commission has recommended that the use be added as a Conditional Use Permit in the Light Industrial "ER" zone.
