NOTICE OF HEARING ON CREATION OF LOCAL IMPROVEMENT DISTRICT NO. 2004-1 CITY OF HAYDEN

NOTICE IS HEREBY GIVEN that Tuesday February 15, 2005, at the hour of 4:00 P.M., at the Hayden City Hall, 8930 N. Government Way, in the City of Hayden, Idaho, has been fixed, pursuant to a Resolution as the time and place for a public hearing at which the owners of property proposed to be assessed within proposed Local Improvement District No. 2004-1 ("LID No. 2004-1") may appear before the City Council (the "Council") of the City of Hayden (the "City") and be heard as to the propriety and advisability of creating of proposed LID No. 2004-1 and the acquisition, construction and installation of the proposed improvements, and hear all complaints, protests, and objections which shall be made in writing, mailed to the address listed above and filed with the City Clerk on or before 5:00 P.M. of said date by any owner of any parcel of land to be assessed.

The boundaries of proposed LID No. 2004-1 are shown in Exhibit "A" attached hereto and hereby made a part hereof.

A general description of the improvements to be constructed (the "Project") consists of the acquisition, construction and installation of underground utilities, and streetscape improvements to include landscaping, median islands, street trees, specialized lighting, irrigation system, banner poles, at lease one colored concrete intersection, widened sidewalks and related improvements and all necessary appurtenances thereto, together with engineering, legal, accounting, costs of bond issuance, and other costs incidental thereto.

All work will be performed and all materials supplied after the advertisement for bids therefor by giving notice calling for sealed bids for construction.

The estimated total cost of the proposed Project is approximately One Million Seven Hundred Sixty-One Thousand Dollars ($1,761,000), of which approximately One Hundred Ninety Thousand Dollars ($190,000) will be paid for from the general funds of the City of Hayden, Five Hundred Thousand Dollars ($500,000) will be paid for from grant funds and the remaining One Million Seventy-One Thousand Dollars ($1,071,000) will be paid for by a levy of assessments against the abutting, adjoining and adjacent lots, parcels and lands benefited by the improvements.

The estimated costs and expenses of the Project to be paid from special assessments shall be assessed against the lots and parcels within proposed LID No. 2004-1 on a benefits derived method of assessment.

Written protests and objections to the creation of LID No. 2004-1 or to the manner of assessment or inclusion of property therein may be filed with the City Clerk on or before 4:00 P.M. on February 15, 2005.
