The Sandpoint City Council will hold a public hearing at their regular meeting on Wednesday, February 16, 2005, to hear public testimony regarding a proposal to establish a new fee of One Hundred Twenty-Five Dollars ($125.00) for inspections of tourist homes, bed and breakfast establishments and day care operations and to explain the reason for this fee. The meeting will begin at 5:30 p.m. in the council chambers at City Hall, 1123 Lake Street, Sandpoint, ID.

NOTICE OF

TRUSTEE'S SALE

On the 18th day of May, 2005, at the hour of 10:00 A.M., of said day, (recognized local time), in the Office of First American Title

Company, 419 Second Ave., Sandpoint, in the County of Bonner, State of Idaho.

First American Title Company of Idaho, Inc., an Idaho Corporation, as successor trustee, will sell at public auction, to the highest bidder, for certified funds, or the equivalent, which is lawful money of the United States of America, all payable at the time of sale in compliance with Section 45-1506(9) Idaho Code, the following described real property, situated in the County of Bonner, State of Idaho, and described as follows, to-wit:

That portion of the Northeast Quarter of the Southeast Quarter, Section 1, Township 56 North, Range 3 West, Boise Meridian, Bonner County, Idaho, lying Southeasterly of the County Road;

EXCEPTING THEREFROM the following described tract, to-wit:

Beginning at the intersection of the Southeasterly right of way line of the County Road and the East line of said Section 1 at a point South 104 feet, more or less, from the East Quarter corner of said Section 1; thence along said section line, South 170 feet; thence West 165 feet, more or less, to the Southeasterly right of way line of said County Road; thence along said road right of way Northeasterly to the point of beginning.

The Trustee has no knowledge of a more particular description of the above referenced real property, but for purposes of compliance with Section 60-113 Idaho Code, the Trustee has been informed that according to the County Assessors office, the address of 5624 Lakeshore Drive, Sagle, Idaho, is sometimes associated with said real property.

Said sale will be made without covenant or warranty regarding

title, possession or encumbrances to satisfy the obligation secured by and pursuant to the power of sale conferred in the deed of trust executed by NITA BRANSON, a married woman as her sole and separate property, as grantor, to FIRST AMERICAN TITLE COMPANY OF IDAHO, INC., an Idaho Corporation, as successor trustee, for the benefit and security of Home first Mortgage, Inc., as beneficiary, recorded November 21, 2003, as Instrument No. 639304, and assigned to CREDIT BASED ASSET SERVICING AND SECURITIZATION LLC, as beneficiary by assignment recorded January 6, 2005, as Instrument No. 667731, Mortgage Records of Bonner County, Idaho.

THE ABOVE GRANTORS ARE NAMED TO COMPLY WITH SECTION 45-1506 (4)(A), IDAHO CODE. NO REPRESENTATION IS MADE THAT THEY ARE, OR ARE NOT, PRESENTLY RESPONSIBLE FOR THIS OBLIGATION.

The default for which this sale is to be made is the failure to pay when due, under Deed of Trust Note, the monthly payments for Principal and Interest of $977.05, due per month for the months of May through August, 2004 and all subsequent payments until the date of sale or reinstatement, with a monthly late charge accruing at $48.85, with interest accruing at an adjustable rate, the current rate is 10.45% per annum, and continuing to accrue from April 1, 2004. Also due are delinquent and unpaid taxes for 2003. The principal balance owing as of

this date on the obligation secured by said Deed of Trust is

$107,075.41, plus accruing interest, costs and advances. All delinquent amounts are now due, together with accruing late charges and interest, unpaid and accruing taxes, assessments, trustee's fees, attorney's fees, and any amounts advanced to protect the security associated with this

foreclosure and that the beneficiary elects to sell or cause the trust property to be sold to satisfy said obligation.
