CITY OF HOPE, IDAHO

AN ORDINANCE FOR THE CITY OF HOPE, BONNER COUNTY, IDAHO, REGULATING FIRECRACKERS AND FIREWORKS WITHIN THE BOUNDARIES OF THE CITY ACCORDING TO I.C. SECTION 39 CHAPTER 26; PROVIDING FOR PENALTIES AND EFFECTIVE DATE AND PUBLICATION THEREOF.

WHEREAS, the City Council of Hope desires to regulate firecrackers and fireworks within the boundaries of the City according to IC Section 39 Chapter 26.

Section 1. It is unlawful for any person to possess, sell, give away or discharge any firecrackers or fireworks of any kind in the City except those fireworks specifically approved by provisions of Idaho Code.

Section 2. It is unlawful for any person to possess, sell, give away or discharge any firecrackers or fireworks of any kind in the City Parks, and all City-owned or leased property, except those fireworks specifically approved under the provisions of IC Section 39 Chapter 26.

Section 3. The City is hereby authorized and empowered to issue written permits for the public display of exhibition of fireworks within the territorial limits of the City. Such permits must specify the time and place for the giving of such public display or exhibition and shall prescribe the conditions governing the conduct of the same. A reasonable fee for issuance of such permit shall be established by the City Clerk.

Section 4. It shall be the duty of the designate of the City to take such steps s may be necessary for enforcement.

Section 5. Any person who violates any provisions of this Ordinance is guilty of a misdemeanor and, upon conviction, shall be fined the maximum provided by State law or incarcerated in the County Jail for not more than one hundred eighty (180) days or by both such fine and imprisonment.

Section 6. If any section, subsection, sentence, clause, phrase or word of this Ordinance is declared to be invalid by a court of competent jurisdiction such declaration shall not affect the validity of the remaining portions of this Ordinance.

Section 7. This Ordinance shall be in full force and effect upon passage, approval and publication of this Ordinance in one issue of the Bonner County Daily Bee, a newspaper of general circulation, published in the City of Sandpoint Idaho, and the official newspaper hereof.

Passed under suspension of the rules and duly enacted as an Ordinance of the City of Hope, Idaho by the City Council of said City, June 8, 2005.
