On Monday, the 13th day of June, 2005, at the hour of 11:00am of said day, in the lobby of the office of Sandpoint Title Insurance, Inc., located at 120 S. Second Ave., Sandpoint, Idaho, 83864, County of Bonner, State of Idaho, KOOTENAI COUNTY TITLE COMPANY, INC., as Successor Trustee, will sell at public auction to the highest bidder, for cash, in lawful money of the United States, all payable at the time of sale, the following described real property, situated in the County of Bonner, State of Idaho, and described as follows:
Parcel 1:
The West half of the Northeast quarter of the Southeast quarter of Section 21, Township 56 North, Range 3 West, Boise Meridian, Bonner County, Idaho.
Parcel 2:
A non-exclusive easement 60 feet in width for ingress, egress and utilities over the existing road, as set forth in the Instrument recorded April 16, 1976 as Instrument No. 174309.

Said sale will be made without covenant or warranty regarding title, possession or encumbrance to satisfy the obligations secured by and pursuant to the power of sale conferred it, the Deed of Trust executed by PETER MURPHY CROWLEY, a single man, to SANDPOINT TITLE INSURANCE, INC., as trustee, for the benefit and security of BRUCE A. DOMINICK and MAY E. DOMINICK, husband and wife, as Beneficiaries, recorded the 18th day of March 1996, as Instrument No. 482084, records of Bonner County, Idaho. THE GRANTOR NAMED HEREIN IS LISTED TO COMPLY WITH SECTION 45-1506(4) (a) OF THE IDAHO CODE. No representation is made whether or not they are currently responsible for the obligation listed herein.
AND FURTHER, that the beneficial interest in said Deed of Trust has been assigned to NANCY L. FOLEY AND GARY E. KUHN, as Co-Trustees of the Bessie G. Kuhn Trust created under the Last Will and Testament of Ernest N. Kuhn dated May 18, 1994, by Instrument recorded June 29, 2001 as Instrument No. 583818, records of Bonner County, Idaho.
AND FURTHER, that a Resignation of Trustee was recorded February 10 2005 as Instrument No. 670102; Appointment of Successor Trustee was recorded February 10 2005 s Instrument No. 670103, records of Bonner County Idaho, wherein KOOTENAI COUNTY TITLE COMPANY, INC. was appointed Successor Trustee.
AND FURTHER, that a breach of the obligation for which the transfer in trust is security has occurred, in that the Grantors above mentioned have failed to make payment in the amount of $76.40 (Seventy Six Dollars and Forty Cents), which amount was due on the 19th of January, 2004, and failure to make payments in the amount of $419.00 (Four Hundred Nineteen Dollars and No Cents) due on the 19th Day of February, 2004, and the the 19th day of each month thereafter through the 19th day of January, 2005 and each month thereafter until paid, together with penalty and interest AND failure to pay Delinquent General Taxes for the first half of the year 2004 in the amount of $332.88 (Three Hundred Thirty Two Dollars and Eighty Eight Cents) together with penalty and interest, together with late charges, service charges and other disbursements, costs, fees or expenses incurred or paid by the Beneficiary and/or Trustee associated with this Notice of Default and/or this foreclosure as provided by the Deed of Trust or Deed of Trust Note, or by Idaho law.
The Balance owing as of the first day of February 2005, on the obligation secured by said Deed of Trust is $41,135.92 (Forty One Thousand One Hundred Thirty Five Dollars and Ninety Two Cents) plus accrued interest at the rate of 8.00% per cent per annum from the 6th day of July, 2004, together with late charges, service charges and any other disbursements, costs, fees or expenses incurred or paid by the Beneficiary and/or Trustee associated with this foreclosure as provided by the Deed of Trust or Deed of Trust Note, or by Idaho law.
