Trustee's Sale No. 02-MS-40219 Notice is hereby given that, Fidelity National Title Insurance Company, the duly appointed Successor Trustee, will on January 18, 2006, at the hour of 11:00 AM, of said day, at the main entrance to Alliance Title & Escrow Corp., 105 Pine Street, Sandpoint, ID, sell at public auction to the highest bidder, for cash, in lawful money of the United States, all payable at the time of sale, the following described real and personal property (hereafter referred to collectively as the "Property"), situated in the County of Bonner, State of Idaho, to-wit: Lot 17, Block 1 of Tama-rack Village, according to the Plat thereof, recorded in Book 4 of Plats, Page 39, Records of Bonner County, Idaho. The Trustee has no knowledge of a more particular description of the above-referenced Property but, for purposes of compliance with Section 60-113 of Idaho Code, the Trustee has been informed that the address of 5199 Hawthorne Dr, Sagle, ID 83860, is sometimes associated with said real property. Said sale will be made with-out covenant or warranty regarding title, possession or encumbrances to satisfy the obligation secured by and pursuant to the power of sale conferred in the Deed of Trust executed by Terry J. Donahoe and Heather J. Donahoe, husband and wife, as Grantor, to Sandpoint Title, as Trustee, for the benefit and security of TMS Mortgage Inc, dba the Money Store, as Benefici-ary, dated 9/14/1995, recorded 9/20/1995, under Instrument No. 472525, Mortgage records of Bonner County, Idaho, the beneficial interest in which is presently held by Provident Bank of Maryland. The above Grantors are named to comply with Section 45-1506(4)(A), Idaho Code. No representa-tion is made that they are, or are not, presently responsible for this obliga-tion. The default for which is sale is made is the failure to pay when due under the Deed of Trust Note dated 9/14/1995, the monthly payment which became due on 6/1/2005 and all subse-quent monthly payments, plus late charges and other costs and fees as set forth.
