NOTICE OF TRUSTEE'S SALE
NOTICE IS HEREBY GIVEN that on January 3, 2006, at 11:00 a.m. the office of Catherine L. Dullea, Attorney at Law, as Successor Trustee, 101 N. Fourth Avenue Suite 204, Sandpoint, ID, will sell at public auction to the highest bidder, for cash in lawful money of the United States of America, all payable at the time of sale, the following real property situated in the County of Bonner, State of Idaho, described as follows:
A tract of land in Section 23, Township 55 North, Range 4 West, Boise Meridian, Bonner County, Idaho, described as follows:
From the Northwest corner of said Section 23, South 88°28'33" East, 1300.87 feet; thence South 01°31'27" West, 668.25 feet; thence South 01°09'52" West, 2314.21 feet; thence South 88°50'08" East 249.74 feet; thence South 01°09'52" West, 1277.18 feet to the True Point of Beginning; thence North 88°50'08" West, 784.77 feet to a point on the boundary of the right of way of the access road; thence South 18°20'08" East, 316.40 feet along the boundary of said access road; thence South 68°50'08" East, 260.58 feet along the boundary of said access road; thence South 89°50'08" East, 434.35 feet along the boundary of said access road; thence North 01°09'52" East 379.79 feet to the True Point of Beginning.

Said sale will be made, without covenant or warranty regarding title, possession or encumbrances, to satisfy the obligations secured by and pursuant to the power of sale conferred in the Deed of Trust executed by ANTHONY H. JABAAY and DELORES F. JABAAY, husband and wife, as Grantors to Sandpoint Title Insurance, as Trustee, and said Trustee having resigned and the Beneficiaries having appointed Catherine L. Dullea, Attorney at Law, as Successor Trustee, for the benefit and security of LESTER A. SANDERS and MARY SANDERS, husband and wife, as original Beneficiaries, said Deed of Trust having been recorded on June 2, 2003, as Instrument No. 625841, official records of Bonner County, Idaho. The Beneficial interest was assigned to LESTER A. SANDERS AND MARY SANDERS, AS CO-TRUSTEES OF THE SANDERS FAMILY TRUST DATED THE 13TH DAY OF FEBRUARY, 2004, AND THEIR SUBSTITUTES AND SUCCESSORS AS TRUSTEE THEREUNDER, recorded February 27, 2004, under Instrument No. 644825, records of Bonner County, Idaho.
THE ABOVE GRANTORS ARE NAMED TO COMPLY WITH S45-1506(4) (a) IDAHO CODE. NO REPRESENTATION IS MADE THAT THEY ARE, OR ARE NOT, PRESENTLY RESPONSIBLE FOR THIS OBLIGATION.
The default for which the sale is to be made is the failure of the Grantors and/or assumptive Grantor(s) to pay in full when due the outstanding principal balance plus accrued interest thereon, failure to pay default fee of $100.00, and failure to pay attorney fees of $255.00.
The balance owing as of the date hereof on the obligation secured by said Deed of Trust is the amount of $108,000.00, plus accrued interest at the rate of 6.5% per annum from May 26, 2005, plus any other costs or expenses associated with this obligation or foreclosure as provided by the Deed of Trust or Deed of Trust Note or by Idaho law.
