AN ORDINANCE OF THE CITY OF SANDPOINT, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, PROVIDING FOR THE ANNEXATION OF A 10.02-ACRE PARCEL AND A 21-ACRE PARCEL OF REAL PROPERTY AS HEREIN DESCRIBED; PROVIDING FOR THE AMENDMENT OF THE SANDPOINT CITY CORPORATE BOUNDARIES; PROVIDING A LEGAL DESCRIPTION OF THE PROPERTIES; PROVIDING FOR NOTICE TO COUNTY TREASURER, ASSESSOR AND RECORDER AND STATE TAX COMMISSION; ADOPTING AN INITIAL ZONING DESIGNATION OF RESIDENTIAL "A" FOR THE PROPERTIES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS: The annexation of the parcels of land described hereinafter meets the requirements of the Sandpoint Comprehensive Plan; and

WHEREAS: The property annexed is contiguous and adjacent to the current City of Sandpoint corporate boundaries and the property lies within the Area of City Impact for the City of Sandpoint; and

WHEREAS: The property owners have requested and consented in writing to the annexation of the real property; and

WHEREAS: The initial zoning designation of Residence "A" is also consistent with the Sandpoint City Comprehensive Plan.

NOW, THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SANDPOINT, BONNER COUNTY, IDAHO:

SECTION 1. The territory lying within the following described legal description shall be and is hereby annexed into and incorporated within the corporate boundaries of the City of Sandpoint, Bonner County, Idaho, pursuant to Idaho Code 50-222 and Sandpoint City Code, Title 1, Chapter 11:

The South 1/2 of the North 1/2 of the SW 1/4 of the SE 1/4 of Section 3, Township 57 North, Range 2 W.B.M., less County right-of-way.

SECTION 2. The territory lying within the following described legal description shall be and is hereby annexed into and incorporated within the corporate boundaries of the City of Sandpoint, Bonner County, Idaho, pursuant to Idaho Code 50-222 and Sandpoint City Code, Title 1, Chapter 11:

A parcel of land located in a portion of the SE 1/4 of Section 3, Township 57 North, Range 2 W.B.M., Bonner County, Idaho, more particularly described as follows:

Commencing at the southeast corner of said SE 1/4; thence along the south line of the SE 1/4 South 89o 18' 57" West 1185.18 feet to an intersection with the centerline of Sand Creek, said point being the True Point Of Beginning; thence northerly along said centerline approximately 3130 feet to an intersection with the north line of the South 1/2 of the NE 1/4 of said SE 1/4 of Section 3; thence along said north line South 89o 12' 23" West 263.89 feet to the west line of the East 1/2 of said SE 1/4; thence South 43o 36' 08" West 68.97 feet to the easterly right-of-way of Vedelwood Drive; thence along said right-of-way the following three (3) courses:

1. 65.38 feet along a clockwise curve with a radius of 230.00 feet, (the chord of which bears South 21o 19' 10" East 65.16 feet);

2. South 13o 46' 14" East 45.83 feet;

3. 24.53 feet along a clockwise curve with a radius of 230.00 feet (the chord of which bears South 10o 42' 26" East 24.52 feet);

Thence North 89o 00' 26" East 10.18 feet to said west line of the East 1/2 of the SE 1/4; thence along said west line South 00o 39' 03" East 1801.71 feet to the south line of said Section 3; thence along said south line North 89o 18' 57" East 137.41 feet to the True Point Of Beginning; less any portion lying within the Schweitzer Cutoff Road right-of-way.

SECTION 3. The corporate boundaries of the City of Sandpoint and Sandpoint City Code 1-10-1 shall be and are hereby amended as listed in Sections 1 and 2.

SECTION 4. The owners of said real property hereby agree to seek immediate annexation into the Independent Highway District boundaries.

SECTION 5. The Sandpoint City Clerk shall provide notice of this Ordinance to the Bonner County Assessor, Treasurer, and Recorder, and to the Idaho State Tax Commission in the manner required by Idaho Code Sections 50-223 and 63-215.

SECTION 6: The real property listed in Sections 1 and 2 are hereby given a zoning designation of Residence "A" as defined by City Code; and the Zoning Map of the City is hereby amended to reflect this change.

SECTION 7: This Ordinance shall take effect and be in full force upon its passage, approval, and publication according to law.

PASSED AND ADOPTED as an Ordinance of the City of Sandpoint, Bonner County, Idaho, at a regular session of the City of Sandpoint City Council on the 19th day of April, 2006.
