ORDINANCE NO. 237

AN ORDINANCE OF THE CITY OF EAST HOPE, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AMENDING PROCEDURES FOR A PROPERTY LINE ADJUSTMENT; PROVIDING FOR SEVERABILITY; REPEALING CONFLICTING ORDINANCES AND PROVIDING AN EFFECTIVE DATE.

SECTION 1. Section 8-2 is hereby amended as follows;

SECTION 8-2 APPLICABILITY: In lieu of other zoning procedures, a property line adjustment ("P.L.A.") procedure may be used for existing adjacent lots or parcels within the corporate limits of the city and: of the following criteria apply;

A. The property line adjustment is to combine two or more lots or parcels; or

A. If the existing lots or parcels to be adjusted are adjacent and are within the corporate limits of the city;

B. When the The property line adjustment does not increase the number of buildable lots; and

C. To combine two or more lots or parcels; and

D.C. If the The resulting lots are no smaller in area than the size that will allow for the stated building setbacks and a building as permitted in the respective zones.

Section 2. Severability. This ordinance is hereby declared to be severable. Should any portion of this ordinance be declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purpose(s) of the ordinance before the declaration of partial invalidity.

Section 3. Repeal of Conflicting Provisions. All provisions of the current or ordinances of the City of East Hope which conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict.

Section 4. Effective Date and Publication. This ordinance shall be effective upon its passage and publication in ne issue of the Bonner County Daily Bee, which is hereby declared to be the official newspaper of the City for publication of this ordinance.
