ORDINANCE NO. 1142

AN ORDINANCE OF THE CITY OF SANDPOINT, A MUNICIPAL CORPORATION OF IDAHO, VACATING RIGHT OF WAYS AT THE FORMER L.P. MILL SITE WITH THE EXCEPTION OF MAPLE STREET; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE HEREOF.

WHEREAS, a public hearing was held on December 21, 2005, before the Sandpoint City Council regarding this proposed vacation; and

WHEREAS, notices of the public hearing were published and mailed to property owners s required by law; and

WHEREAS, the City Council finds it to be in the public interest that said right-of-way be vacated;

NOW THEREFORE, BE IT ORDAINED, by the Mayor and City Council of the City of Sandpoint:

Section 1. That the following described streets, to wit:

All public right of ways West and South of the Great Northern Railroad (now Union Pacific), East of Boyer Ave., and North of Larch Street. Excepting therefrom Maple Street.

be and the same are herby vacated.

Section 2. That ownership of said roads shall vest with the property owner owning the property surrounding vacated roads.

Section 3. That the applicant/owner shall be responsible for relocating any utilities on the property including power lines, thee sewer pump station and fire hydrant, at the owner's expense.

Section 4. That all ordinances and parts of ordinances inconsistent with this ordinance are hereby repealed to the extent of such inconsistency.

Section 5. This ordinance shall take effect and be in full force upon its passage, approval and publication according to law.

Passed by the City Council as an ordinance of the City of Sandpoint on this 18th day of January, 2006.
