ORDINANCE
NO. 1143
AN ORDINANCE OF THE CITY OF SANDPOINT, BONNER COUNTY, IDAHO, MUNICIPAL CORPORATION OF THE STATE OF IDAHO; PROVIDING FOR ZONE CHANGES IN THE VICINITY OF THE SANDPOINT AIRPORT FROM RESIDENTIAL TO LIGHT INDUSTRIAL; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE.
WHEREAS: It is desirable and beneficial to amend zones from time to time to reflect current and future best land use;
WHEREAS: Certain aspects of the current zones do not promote desirous existing and future land use conditions; and
WHEREAS: The Sandpoint Mayor and City Council find it in the public interest to amend the Sandpoint City property zones.
NOW THEREFORE, be it ordained by the Mayor and City Council of the City of Sandpoint:
Section 1: Statement of Purpose
The purpose of this ordinance is to provide zone changes, which will make zones in the vicinity of the Sandpoint Airport compatible with airport uses.
Section 2: Rezone of Property
That the zoning districts are hereby changed from Residence "A" to Light Industrial "ER" for the following parcels:
1. A parcel located west of Boyer Avenue, north of Mountain View Drive, east of the Airport, and described as the SE 1/4 of the SW 1/4 of Section 10, Township 57 North, Range 2 W.B.M., Less Lot 12 and Less the Airport.
2. Property east of North Boyer Avenue, west of Boyer Avenue, and south of Schweitzer Cutoff Road, described as the West 1/2 of the NE 1/4, west of Boyer Avenue, less the subdivision known as Grand View Estates, and less the North 1/2 of the NW 1/4 of the NE 1/4 west of the Airport in Section 10, Township 57 North, Range 2 W.B.M.
Section 3: That the official Zoning Map of the City is hereby amended to reflect the above changes.
Section 4: Repeal and Severability
A. That any provision of the Sandpoint City Code found to be inconsistent with this Ordinance be and the same is hereby repealed.
B. Should any provision of this ordinance be deemed unlawful or unconstitutional, such finding shall not effect the remaining provisions of this ordinance.
Section 5: Effective Date
This Ordinance shall be in full force and effect from and after its passage, approval, and publication according to law.
PASSED BY THE CITY COUNCIL as an ordinance of the City of Sandpoint on this 18th day of January, 2006.
