REQUEST FOR PROPOSAL AND QUALIFICATIONS

The Bonner County Noxious Weed Department seeks Statements of Proposal, Qualifications and project costs from companies licensed and qualified in aquatic herbicide application; and experience in aquatic weed survey and mapping techniques.

1. PURPOSE

To control Eurasian Watermilfoil on lake Pend Oreille, Pend Oreille River, Gamlin Lake and Shepherd Lake (see attached locations).

2. equipment and labor

A. Contractor to provide:

? Herbicide (see attached recommended herbicide list with the application rate listed)

? Herbicide application labor

Equipment for application of herbicides to area of infestation in the identified bodies of water, a public waterway. This includes

?Boat

?Mounted injector system for liquid herbicide application and/or

?Mounted spreader system for granular herbicide applications.

?GPS capability to locate infestations and determine acreage covered.

?Production of mapping of treated area within 14 days of project completion

B. Contractor must have:

?A current Idaho Professional Applicator license for Aquatic Herbicides.

?A current Public Works Contractor's license.

? Proof of worker's compensation insurance.

?Proof of liability insurance in the amount of $2,000,000.00. Proof will come directly from the insurance company at the request of the County.

?Name Bonner County as also insured.

?Must provide a 5% performance bond.

?We require prior experience using herbicides to control aquatic vegetation for this project.

?We require prior aquatic plant mapping experience for this project.

3. WORK TO BE PERFORMED

A. Contractor shall be responsible for treating infestations of Eurasian watermifoil on Lake Pend Oreille, Pend Oreille River, Gamlin Lake and Shepherd Lake, as represented in the attached list and directed by the County representative. Contractor shall assist the County and the volunteers to post treatment areas for notification times and assist in the removal of the signs upon completion. Contractor shall collect water samples as required by the permitting agencies for testing and deliver to the County for processing.

B. Contractor shall keep appropriate logs of work performed and map locations of colonies treated for future reference. Copies of all such information shall provided to bonner County Noxious Weed Control. Contractor logs shall indicate the following information:

1. Daily date and time of job start and end

2. Number and names of staff working.

3. Locations of work performed

4. Weather conditions

5. Approximate size of infestation (acres and/or square feet)

6. All of the above data shall be in the form of both a digital copy and four paper copies delivered to the County within 14 days after completion of the project.

C. Work shall not be done during unsafe weather conditions. Our target dates are from the third week of june, 2006 through July, 2006.

D. The County will provide assistance to the Contractor in locating infestations.

4. LENGTH OF CONTRACT/FUNDING

A. Total acreage is roughly estimated at 3,800 surface acres at specified locations See attached maps and list.

B. Exact acreage and treatment area will depend upon grant funding and may be subject to changes in locations, herbicide usage and total acreage to be treated.

C. No guarantees or predictions can be made at this time for additional work or funding for this effort in this or future fiscal years.

Submit to bonner County your proposal, qualifications and the cost of the total project, for the treatment of Eurasian Watermifoil located in the identified location. include all of the required information listed above.

All statements of Proposal, Qualifications and total project costs must be received in the Bonner County Commissioners Office, 215 S. First Ave., Sandpoint, ID 83864 on or before Friday, June 9, 2006 at 10:00 a.m.

Your statements will be reviewed by the Bonner County Commissioners, bonner County Noxious Weed Advisory Board Members, Bonner County Public Work Director for Weeds and the Bonner County Weed Superintendent. The selection team shall review, screen and rank the Statements based on the criteria described above. The selection team reserves the right to conduct interviews (if necessary) of the most qualified firm or firms or to make a recommendation straight from the proposals to the County Commissioners. Selection of the contractor will be made prior to June 15, 2006. ORDINANCE NO. 477

FIRE PROTECTION

STANDARDS ORDINANCE

AN ORDINANCE OF BONNER COUNTY, IDAHO, SETTING FORTH ITS AUTHORITY; AMENDING CHAPTER 23 OF TITLE 12, BONNER COUNTY REVISED CODE, BY PROVIDING STANDARDS AND REQUIREMENTS FOR FIRE PROTECTION MEASURES FOR SUBDIVISIONS, PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, Idaho Code, Title 67, Chapter 65, provides for the adoption of land use standards for the purposes of protecting property rights and enhancing property values, together with the purposes of promoting the health, safety, and general welfare of the people; and

WHEREAS, the Board of Commissioners finds that standards for fire protection have not been specifically provided within Chapter 23, Title 12, of the Subdivision Regulations and that the county's fire districts require sufficient water supplies and fire protection measures to adequately defend Bonner County citizens from fire hazards; and

WHEREAS, Bonner County is facing rapid growth in its unincorporated areas and realizes the need for adequate fire protection for the present and future residents of the County; and

WHEREAS, Idaho Code S67-6518 provides the authority for the governing board to adopt development standards for building and lot design and public and private utilities and development; and

WHEREAS, Bonner County Revised Code sets forth in Chapter 1 the purpose and intent of zoning codes and establishes that the codes are designed to promote the "health, safety, morals and the general welfare of Bonner County," and have been designed, among other things, "to secure from fire" and to facilitate "…water, sewage, schools, parks, other public requirements;" and

WHEREAS, the Bonner County Commissioners desire to establish subdivision standards for fire protection provisions; and

WHEREAS, the Bonner County Planning and Zoning Commission did hold a public hearing May 4, 2006, and recommended approval of the ordinance amendment; and

WHEREAS, the Bonner County Board of Commissioners did hold a public hearing on May 24, 2006, and concluded the amendment is in accord with the goals, objectives and policies of the Bonner County Comprehensive Plan.

NOW, THEREFORE BE IT ORDAINED by the Board of County Commissioners of Bonner County, Idaho that the following be and is hereby adopted as an ordinance of Bonner County:

SECTION 1: AUTHORITY

This Ordinance is adopted pursuant to the authority granted at Chapter 65, Title 67, Idaho Code, and pursuant to the procedural requirements contained at Section 67-6509, Idaho Code.

SECTION 2: AMENDING CHAPTER 23 OF TITLE 12, BONNER COUNTY REVISED CODE, BY PROVIDING STANDARDS FOR FIRE PROTECTION MEASURES WITHIN SUBDIVISIONS

PART A:

There is hereby added to Section 12-2305 of the Bonner County Revised Code a new paragraph (j) which shall read as follows:

Section 12-2305, Design criteria for all subdivisions.

(j) All proposed lots shall be designed by the applicant to provide a fire protection plan for the proposed lots to provide at a minimum an assessment of fire risk and plans to reduce the risk, and provisions for defensible space, where material capable of allowing a fire to spread unchecked will be treated, cleared or modified to slow the rate and intensity of an advancing wildfire and to create an area for fire suppression operations to occur and for at least one (1) of the following:

(1) Prior to final plat, an approved water and fire hydrant system capable of providing one thousand (1,000) gallons per minute for a minimum of two (2) hours, where, a community water system exists or is proposed as part of the development and is capable of delivering the pressurized water supply necessary for delivering fire flows as prescribed by International Fire Code, as adopted by the state fire marshal, and such later editions as may be so published and adopted by the state fire marshal, or as amended, modified or superseded, and incorporated herein by reference with a copy on file with the office of the clerk of the Board of County Commissioners, and herein after referred to as IFC.

(2) A note on the final subdivision plat stating: "At the time of Building Location Permit or Building Permit, the lot owner shall install a minimum two thousand (2,000) gallon water storage system, meeting IFC standards." Refill on demand is not required to meet IFC standards.

(3) A note on the final subdivision plat stating: "The installation of an approved IFC residential fire suppression sprinkler system is required in all newly constructed residences."

(4) Prior to final plat, a man-made or natural water source with a dry hydrant capable of delivering adequate water supply as prescribed by IFC .

(5) A note on the final subdivision plat stating: "At the time of building permit or building location permit, the lot owner shall install an approved fire suppression method to the satisfaction of Bonner County."

SECTION 3: SEVERABILITY

The provisions of this Ordinance are hereby declared to be individually severable. Should any provision of this ordinance be declared invalid by a court of competent jurisdiction, such declaration shall not affect the validity of the remaining provisions.

SECTION 4: EFFECTIVE DATE

This Ordinance shall be in full force and effect upon its passage and publication in one (1) issue of the Bonner County Daily Bee newspaper.
