In compliance with your invitation for bids to be received March 21, 2006, the bidder certifies to have examined the location of work and/or materials sites, and is satisfied as to the condition to be encountered, and that the plans, specifications, contract and method of payment for such work is understood. The bidder hereby proposes to furnish the material and perform the work of constructing a pedestrian & bicycle path, including pavement, base, excavation, retaining wall, utilities, signing, lighting, drainage, and traffic control along each side of US-95 MP 471.65 to MP 471.75; Long Br. Pedestrian/Bike UPass, known as Idaho Federal Aid Project No. STP-5110(145), in Bonner County, Key No. 08708, in accordance with the 2004 Idaho Standard Specifications, April 2005 Supplemental Specifications and Quality Assurance Manual, QA Special Provisions, Drawings and Plans for the work, Special Provisions, FHWA-1273 Federal Aid Contract Provisions, Civil Rights Special Provisions, General Wage Decision ID20030019, all addenda issued prior to bid opening, and the consideration of the unit prices bid for the several items set forth in the attached bid schedule.

On the acceptance of this proposal for said work, the undersigned will execute Contract Forms CA in accordance with the bid as accepted, and furnish the Contract Performance and Payment Bonds on Forms CB with approved and sufficient surety within 15 days after the prescribed forms are presented for signature.

The bidder further agrees that if awarded the contract work will be completed as stated in the Special Provisions, after authority to proceed has been given in conformity with and subject to such extensions as may be authorized by the terms of "Determination and Extension of Contract Time," Subsection 108.06 of the said Standard Specifications.

Accompanying this proposal is a Certified Check or a Cashier's Check drawn on an Idaho bank in the amount of five percent of the total amount bid, made payable to the Idaho Transportation Department, or a Bidder's Bond in the amount of five percent of the total amount bid.

By signature on this proposal, the bidder declares under penalty of perjury under the laws of the United States, that the firm, association, or corporation has not by or through any of its officers, partners, owners or any other person associated therewith, either directly or indirectly, entered into any agreement, participated in any collusion, or otherwise taken any action in restraint of free competitive bidding in connection with this highway project, and is not financially interested in or otherwise affiliated in a business way with any other bidder on this project.

The bidder hereby agrees to pay labor not less than the prevailing rates of wages set forth in the wage determination decision set forth for this project.

The undersigned being duly sworn upon oath deposes and says that it complies with the provisions of Section 72-1717 Idaho Code (Drug Free Workplace program).
