Under and by virtue of a Judgement and Decree of Foreclosure rendered out of the United States District Court for the District of Idaho, filed on July 15, 2005, and the Order of Sale issued on January 19, 2006 in the above-entitled action, wherein the United States of America, the above-named Cross-Plaintiff, obtained a judgement against the Cross-Defendant Gladys Marie Jayo, individually and as personal representative of the Estate of Paul Jayo, deceased, in the amount of $1,020,123.67, plus costs and interest as specified in said decree;

I am commanded to sell the real and appurtenant property situated in Bonner County, State of Idaho, as one sale parcel as described below:

Tract No. 1: described as follows: (Parcels 1, 3, 4, 5, 6, 7, & 8)

PARCEL 1, described as follows:

The Northeast Quarter, less the county road right of way therein, AND LESS that part of the East 250 feet thereof lying North of the County Road right of way, which part was conveyed to Boundary Development Company, Inc., by instrument recorded August 26, 1977, in Book 168 of Deed, at pages 415, records of Bonner County, Idaho; the North half of the Southwest Quarter, and the North half of the Southeast Quarter, all in Section 21, Township 59 North, Range 5 West, Boise Meridian, Bonner County, Idaho; and

NOTICE IS HEREBY GIVEN that on April 19, 2006 at 11:00 o'clock a.m. of said day, (or if the United States Marshal is unavoidably detained, immediately upon his arrival)) on the front steps of the Bonner County Courthouse in Sandpoint, Idaho, I will sell heretofore-described real property to the highest and best bidder for cash in lawful money of the United States of America.

The terms of the sale are as follows: A personal check in the amount of ten percent (10%) of the bid will be accepted at the time of the sale, with a certified or cashier's check for the full amount of the bid to be delivered to the United States Marshal within 24 hours of the time of the sale. Upon delivery of the aforementioned certified or cahier's check, the personal check will be returned. If the full purchase price has not been received within 24 hours of the time of the sale, the ten percent (10%) deposit will be forfeited to the United States Marshal to offset cost involved. The United States and only the United States may enter a credit bid at the sale of the real property up to the amount of the judgement and costs and interest as set forth in the judgement .

Pursuant to Idaho Code, S 11-130, the heretofore-described real property is subject to a period of redemption to and including one (1) year from the date of the sale of real property.
