NOTICE OF TRUSTEE'S SALE
NOTICE IS HEREBY GIVEN that on January 4, 2007, at 11:00 a.m. the office of Catherine L. Dullea, Attorney at Law, as Successor Trustee, 101 N. Fourth Avenue Suite 204, Sandpoint, ID, will sell at public auction to the highest bidder, for cash in lawful money of the United States of America, all payable at the time of sale, the following real property situated in the County of Bonner, State of Idaho, described as follows:
Lots 2, 3, 6, 7, 10, 11, 14, 15, 17 through 30, 32 and 33 in Block 14, together with that part of the East Half of vacated Montana Avenue and adjacent and contiguous to Lots 2, 3, 6 and 7 of Newport, according to the Plat thereof, recorded in Book 1 of Plats, Page 6, records of Bonner County, Idaho;
TOGETHER WITH the vacated alley in said Block 14;
EXCEPT the West Half of said vacated alley adjacent to Lots 31 and 34 of said Block 14;
AND
That parcel of land lying Easterly of a portion of Block 14 of Newport, Idaho, according to the Plat thereof, recorded in Book 1 of Plats, Page 6, records of Bonner County, Idaho, more particularly described as follows:
Beginning at a point which is the Northeast corner of Lot 1 of above Block 14; thence due East to the mean high water line of the Pend Oreille River as it now exists; thence Southeasterly along above mean high water line to a point which is the intersection of the extension of the North boundary line of Lot 24 in above Block 14 extended Easterly to the above mean high water line; thence Westerly along above extension to the Northeast corner of the above Lot 24; thence Northerly along the East boundary line of above Block 14 to the Northeast corner of above Lot 1, the point of beginning.

Said sale will be made, without covenant or warranty regarding title, possession or encumbrances, to satisfy the obligations secured by and pursuant to the power of sale conferred in the Deed of Trust executed by MARK L. ROGERS, a married man as his sole and separate property, as Grantor to Sandpoint Title Ins., as Trustee, and said Trustee having resigned and the Beneficiary having appointed Catherine L. Dullea, Attorney at Law, as Successor Trustee, for the benefit and security of INDEPENDENT MORTGAGE LTD. CO., an Idaho limited liability company, as original Beneficiary, said Deed of Trust having been recorded on December 15, 2005, as Instrument No. 694422, official records of Bonner County, Idaho. The Beneficial interest was assigned to Dan S. Jacobson, a married man as his sole and separate property, as to an undivided 20% interest, The Earle-Henrion Trust Dated January 27, 1998, sole and separate property of Daniel C. Earle, as to an undivided 20% interest, both by Assignment recorded December 15, 2005, as Instrument No. 694425 ; and Amy Carter, an unmarried woman, as to an undivided 20% interest by Assignment recorded June 6, 2006, as Instrument No. 705600; and Anders B. Hagelin and Deborah A. Pehrson, husband and wife, as to an undivided 20% interest by Assignment recorded June 14, 2006, as Instrument No. 706107, and Equity Trust Company FBO Julie Thompson IRA, as to an undivided 20% interest, by Assignment recorded June 26, 2006, as Instrument No. 707024.
THE ABOVE GRANTOR IS NAMED TO COMPLY WITH S45-1506(4)(a) IDAHO CODE. NO REPRESENTATION IS MADE THAT HE IS, OR IS NOT, PRESENTLY RESPONSIBLE FOR THIS OBLIGATION.
The default for which the sale is to be made is the failure of the Grantor and/or assumptive Grantor(s) to make monthly payments of in the amount necessary to pay all the interest accrued up to the date in which each monthly installment is due, for the months of May, June, July and August, 2006; failure to pay escrow fees in the sum of $13.50; failure to pay late fees in the sum of $200.00, each, for the months of May, June, July and August failure to pay default and attorney fees of $250.00.
The balance owing as of the date hereof on the obligation secured by said Deed of Trust is the amount of $207,000.00, plus accrued interest at the rate of 12.0% per annum from April 1, 2006 to July 8, 2006, and at the rate of 18.0% per annum, from July 8, 2006, plus any other costs or expenses associated with this obligation or foreclosure as provided by the Deed of Trust or Deed of Trust Note or by Idaho law.
