AN ORDINANCE OF BONNER COUNTY, IDAHO, CITING ITS AUTHORITY, AND PROVIDING FOR THE AMENDMENT OF THE OFFICIAL ZONING MAP OF BONNER COUNTY BY THE RECLASSIFICATION OF LANDS GENERALLY LOCATED IN SECTION 25, TOWNSHIP 57 NORTH, RANGE 2 WEST, B.M., FROM SUBURBAN AND SUBURBAN 1/3 TO RURAL, AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the Bonner County Planning and Zoning Commission did hold a public hearing on July 27, 2006, on the ZC316-05 request for a change in zoning designation according to the requirements for such hearings set forth at Section 67-6509, Idaho Code, and at Title 12, Bonner County Revised Code; and

WHEREAS, the Bonner County Planning and Zoning Commission did find that the zone change request ZC316-05 is in accordance with the Bonner County Comprehensive Plan and did recommend to the Board of County Commissioners that the zone change request be approved; and

WHEREAS, the Board of County Commissioners did hold a public hearing on September 13, 2006, on the ZC316-05 request for a change in zoning designation according to requirements of such hearings set forth at Section 67-6509, Idaho Code and at Title 12 of the Bonner County Revised Code; and

WHEREAS, the Board of County Commissioners did find that the zone change request ZC316-05 is in accordance with the Bonner County Comprehensive Plan;

NOW, THEREFORE BE IT ORDAINED, by the Board of County Commissioners that the following be and is hereby adopted as an ordinance of Bonner County, Idaho:

SECTION 1: AUTHORITY

This ordinance is adopted pursuant to authority granted to Bonner County at Chapter 65 of Title 67, Idaho Code.

SECTION 2: AMENDING THE OFFICIAL ZONING MAP

The Official Zoning Map of Bonner County, Idaho is hereby amended by the reclassification of the following described lands from Suburban and Suburban 1/3 to Rural:

A parcel of land located in a portion of Section 25, Township 57 North, Range 2 West, Boise Meridian, Bonner County, Idaho, more particularly described as follows: Beginning at the Southeast corner of Lot 19 of Mountain Pine Shores, Book 3 of Plats, Page 14, records of Bonner County; Thence North 00°59'55" East along the East line of Lots 19 and 20 of Mountain Pine Shores, a distance of 345.42 feet; Thence South 8914'07" East, a distance of 109.00 feet; Thence North 00°38'58" East, a distance of 323.61 feet; Thence North 89°14'07" West, a distance of 109.00 feet to an intersection with the East line of Lot 22 of Mountain Pine Shores; Thence along said East line North 00°35'43" East, a distance of 268.85 feet to an intersection with the Southerly right-of-way of Bottle Bay Road, said point being a point of non-tangent curvature; Thence along said right-of-way the following eight (8) courses:

1. 41.52 feet along a curve to the left with a radius of 220.00 feet (the chord of which bears North 48°33'36" East, 41.46 feet);

2. North 43°09'11" East, 89.96 feet;

3. 109.49 feet along a curve to the right with a radius of 205.00 feet (the chord of which bears North 58°2715" East, 108.20 feet);

4. North 73°45'20" East, 57.93 feet;

5. 99.01 feet along a curve to the left with a radius of 181.00 feet (the chord of which bears North 58°05'06" East, 97.78 feet);

6. North 42°24'52" East, 33.66 feet;

7. 99.64 feet along a curve to the right with a radius of 175.00 feet (the chord of which bears North 58°43'31" East, 98.30 feet);

8. North 75°02'10" East, 71.45 feet;

Thence South 64°27'47" East, a distance of 111.15 feet; Thence North 50°47'22" East, a distance of 222.87 feet; Thence North 03°30'50" East, a distance of 135.94 feet to an intersection with said Southerly right-of-way of Bottle Bay Road; said point being a point of non-tangent curvature; Thence along said right-of-way, 30.33 feet along a curve to the left with a radius of 266.94 feet (the chord of which bears North 34°08'34" East, 30.31 feet); Thence along said right-of-way, North 30°52'59" East, a distance of 195.05 feet; Thence North 42°48'59" West, a distance of 194.30 feet to an intersection with the meander line of Lake Pend Oreille; Thence along said meander line, North 41°51'17" East a distance of 263.58 feet; Thence along said meander line, North 61°17'49 East, a distance of 218.80 feet; Thence South 30°59'16" East, a distance of 223.43 feet to an intersection with the Southerly right-of-way of Bottle Bay Road, said point being a point of non-tangent curvature; Thence along said right-of-way the following four (4) courses:

1. 26.93 feet along a curve to the left with a radius of 283.00 feet (the chord of which bears North 60°18'45" East, 26.92 feet);

2. North 57°35'09" East, 91.30 feet;

3. 82.59 feet along a curve to the right with a radius of 175.00 feet (the chord of which bears North 71°06'24" East, 81.83 feet);

4. South 84°37'39" East, 37.54 feet;

Thence South 44°33'56" East a distance of 999.50 feet to an intersection with the North line of Lot 18 of Second Addition to Mountain Pine Shores as recorded in Book 3 of Plats, Page 36, records of Bonner County; Thence along the North line of Lots 18 and 19 of said Second Addition to Mountain Pine Shores, North 89°24'10" West a distance of 847.58 feet to the Northwest corner of Lot 19; Thence along the West line of said Lot 19, South 00°35'52" West a distance of 665.91 feet to an intersection with the North line of Lot 20; Thence N 89°24'10"W along the North line of Lot 20 and Lot 34, a distance of 356.62 Thence continuing North 89°24'10" West, a distance of 309.23' along the North line of Lot 34, Thence South 00°00'51" West along the west line of said Lot 34, a distance of 659.56 feet to the Northeast corner of Lot 1;Thence North 89°30'35" West along the North line of Lot 1, a distance of 560.04;Thence North 89°07'53" West along the North line of Lot 11 of Mountain Pine Shores, a distance of 97.02 feet to the southeast corner of Lot 19 and the True Point of Beginning.

SECTION 3: EFFECTIVE DATE

This ordinance shall be in full force and effect upon its passage, approval and publication in one (1) issue of the Bonner County Daily Bee Newspaper, and upon the entry of the above described zoning reclassification upon the Official Zoning Map or a Supplemental Zoning Map in accordance with the provisions set forth at Chapter 4 of Title 12 of the Bonner County Revised Code.
