AN ORDINANCE OF THE CITY OF SANDPOINT, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, VACATING AN APPROXIMATELY 25-FOOT WIDE STRIP OF UNDEVELOPED RIGHT-OF-WAY LOCATED SOUTH OF THE SOUTHERN BOUNDARY OF LOT 1, JOHNSON, COX & HAMILTON SHORT PLAT, IN THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 10, TOWNSHIP 57 NORTH, RANGE 2 WEST, BOISE MERIDIAN, BONNER COUNTY, IDAHO; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE HEREOF.

WHEREAS, a public hearing was held on February 21, 2007, before the Sandpoint City Council regarding this proposed vacation; and

WHEREAS, the City Council finds it to be in the public interest that said right-of-way be vacated and that it is appropriate that ownership revert to the owner of the adjacent real estate.

NOW, THEREFORE, BE IT ORDAINED, by the Mayor and City Council of the City of Sandpoint:

Section 1: That the following described property, to wit:

An approximately 516-foot by 25-foot strip of undeveloped right-of-way located south of the southern boundary of Lot 1, Johnson, Cox & Hamilton Short Plat in the SW 1 / 4 of the SW 1 / 4 of Section 10, Township 57 North, Range 2 W.B.M.

be and the same is hereby vacated.

Section 2: That ownership of said right-of-way shall revert to the owner of Lot 1, Johnson, Cox & Hamilton Short Plat

Section 3: All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed to the extent of such conflict.

Section 4: This ordinance shall take effect and be in full force upon its passage, approval and publication in one (1) issue of the Bonner County Daily Bee, a newspaper of general circulation published within the City of Sandpoint and the Official newspaper thereof.

PASSED BY THE CITY COUNCIL as an ordinance of the City of Sandpoint on this 21st day of March, 2007.
