NOTICE OF TRUSTEE'S SALE
NOTICE IS HEREBY GIVEN that on December 19, 2007, at 10:00 a.m., at the office of the Successor Trustee at 120 East Lake Street, Suite 317, Sandpoint, Idaho 83864, JOHN A. FINNEY, Attorney at Law, FINNEY FINNEY & FINNEY, P.A., as Successor Trustee, will sell at public auction to the highest bidder, for cash or cash equivalent in lawful money of the United States of America, all payable at the time of sale, the following real property situated in the County of Bonner, State of Idaho, described as follows:
A tract of land in a portion of the South Half (S) of Government Lot 1, and in a portion of the Southeast Quarter of the Northeast Quarter (SENE) of Section 4, Township 55 North, Range 2 West, Boise Meridian, Bonner County, Idaho, more specifically described as follows:
Commencing at the Northeast corner of said Gov't Lot 1 (NE Section Corner); thence South 00°05'08" East along the East line of said Gov't Lot 1 a distance of 660.89 feet; thence South 89°56'17" West along the North line of said S of Gov't Lot 1 a distance of 632.06 feet to the True Point of Beginning; thence continuing South 89°56'17" West a distance of 684.39 feet to the West line of said Gov't Lot 1; thence South 00°03'04" East along said West line, a distance of 597.61 feet; thence leaving said West line, South 72°03'58" East a distance of 621.94 feet; thence North 00°15'22" West a distance of 408.02 feet; thence South 89°47'08" East a distance of 96.13 feet; thence North 00°19'33" West a distance of 382.21 feet to the true point of beginning.
The Successor Trustee has no knowledge of a street address for the above-described real property, but for the purpose of complying with Idaho Code S 60-113, has been informed the real property is located at NNA Westmond Road, Cocolalla, ID 83813, and additional information concerning the location of the real property may be obtained from the Successor Trustee, JOHN A. FINNEY, Attorney at Law, FINNEY FINNEY & FINNEY, P.A., at 208-263-7712.
Said sale will be made without covenant or warranty regarding title, possession, or encumbrances, to satisfy the obligations secured by and pursuant to the power of sale conferred in the Deed of Trust, recorded November 17, 2003 as Instrument No. 638758, records of Bonner County, Idaho, and executed by KIM GARRISON, an unmarried woman, as Grantor, to FIRST AMERICAN TITLE COMPANY, an Idaho Corporation, as Trustee, for the benefit and security of WALTON L. LAW, JR., an unmarried man, as Beneficiary; Said Trustee having resigned and the Beneficiary having nominated and appointed JOHN A. FINNEY, Attorney at Law, FINNEY FINNEY & FINNEY, P.A., 120 East Lake Street, Suite 317, Sandpoint, Idaho 83864, as the Successor Trustee.
The above named grantor is named to comply with Idaho Code Sesction 45-1506 (4)(a). No representation is made that the named Grantor is, or is not, presently responsible for this obligation.
The breach of the obligation and default for which this sale is to be made is the failure to pay when due the outstanding principal and accrued interest due upon maturity on August 25, 2006. The principal balance owing as of June 1, 2006 on the obligation secured by said Deed of Trust is FORTY-NINE THOUSAND ONE HUNDRED NINETY-NINE DOLLARS AND 07/100 ($49,199.07), plus accruing interest at EIGHT PERCENT (8%) per annum. All delinquent payments and the whole sum of principal and interest are now due and payable, subject to the provisions of Idaho Code S 45-1506 (12), together with accruing interest, delinquent taxes, plus penalties and interest, unpaid and accruing taxes, assessments, default fees, trustee's fees, attorney's fees, and premiums for insurance, if any; and any amounts advanced to protect the security associated with this foreclosure, including any costs for searches or insurance as to the record title to the real property.
The Beneficiary elects to sell or cause to be sold such property to satisfy such obligation, to the extent possible, pursuant to law.
