NOTICE OF TRUSTEE'S SALE

On December 21, 2007, at the hour of 10:00 o'clock A.M., of said day in front lobby of North Idaho Title Company, 227 S. First Avenue, Sandpoint, Idaho 83864, C. Jon Nees, a member of the Idaho State Bar, as successor trustee, will sell at public auction, to the highest bidder, for cash, in lawful money of the United States, all payable at the time of sale, the following desribed real property, situated in the County of Bonner, State of Idaho, and described as follows, to-wit:

Lot 1 of Wood View, according to the plat thereof recorded in Book 4 of Plats, at Page 29, records of Bonner County, Idaho;

Situate in Bonner County, Idaho.

Tax Parcel No. RP 00710000010 A.

The Successor Trustee has no knowledge of a more particular description of the above-referenced real property, but for purposes of compliance with Idaho Code Section 60-113, the Successor Trustee has been informed that the address of 402 Wood View Road, Sandpoint, Idaho 83864, is sometimes associated with said real property. Said sale will be made without covenant or warranty regarding title, possession or encumbrances to satisfy the obligation secured by and pursuant to the power of sale conferred in the deed of trust executed by James Hand and Leora Hand, husband and wife, as Grantor, to North Idaho Title Company, as Trustee, and CLS Mortgage, Inc., as Beneficiary, dated November 24, 2006, and recorded as Instrument No. 718075, records of Bonner County, Idaho, the beneficial interest in which was assigned to Japasa, LLC, a Washinton limited liability company, under an Assignment dated December 15, 2006, recorded under Instrument No. 719636.

THE ABOVE GRANTORS ARE NAMED TO COMPLY WITH SECTION 45-1506(4)(A) IDAHO CODE. NO REPRESENTATION IS MADE THAT THEY ARE, OR ARE NOT, PRESENTLY RESPONSIBLE FOR THIS OBLIGATION.

The default for which the foreclosure is to be made is the failure to pay when due, under the Deed of Trust and Note dated November 24, 2006, the monthly payments for principal and interest of $1,254.91 per mont for the month of July, 2007, and all subsequent payments until the date of sale or reinstatement, with a monthly late charge of $125.49 The principal balance owing as of this date on the obligation secured by said Deed of Trust is $121,638.66, plus accruing interest at 12% per annum from June 28, 2007. All delinquent payments are now due, plus accumulated late charges, plus interest and penalty, trustee's fees, attorney's fees, costs and advances made to protect the security associated with this forclosure. The amount necessary to bring the loan current through the July 29, 2007 payment, would be principal and interest payments of $1,254.91, along with all costs and fees associated with this foreclosure. The beneficiary elects to sell or cause the trust property to be sold to satisfy this obligation.
