PUBLIC HEARING

Notice is hereby given that the Sandpoint City Council will hold public hearings at their regular meeting on Wednesday, February 21, 2007, at 5:30 p.m. in the council chambers at City Hall, 1123 Lake Street, Sandpoint, ID, to consider the following vacations:

1. VAC07-01- A request by Quest Aircraft to vacate an undeveloped portion of Great Northern Road right-of-way located in a portion of the SE 1 / 4 of the SE 1 / 4 of Section 9, Township 57 North, Range 2 W.B.M. The existing Great Northern Road is located outside the 50-foot wide right-of-way as described in Book A, Page 71 of Right-of-Way Deeds. In exchange, the petitioner will proceed with dedication of right-of-way for a portion of the existing roadway.

2. VAC07-02- A request by John McKeown to vacate an approximately 25-foot wide strip of undeveloped right-of-way located south of the southern boundary of Lot 1, Johnson, Cox & Hamilton Short Plat in the SW 1 / 4 of the SW 1 / 4 of Section 10, Township 57 North, Range 2 W.B.M. The 516 feet strip abuts the western boundary of the Bonner County Airport and only connects to another piece of right-of-way at a single point at its southwest corner.

3. VAC07-03- The City of Sandpoint is initiating the vacation of all interest outside the following legal description, commonly known to as Dock Street: A strip of land 26.00 feet in width located in a portion of Section 23, Township 57 North, Range 2 W.B.M., Bonner County, Idaho, the centerline of which is more particularly described as follows: Commencing at the northwest corner of said Section 23; thence N89°55'47"E, 130.95 feet to a point on a line parallel with and 200 feet easterly of (as measured perpendicularly to) the centerline of the Burlington Northern Santa Fe Railroad; thence S10°45'10"E along said parallel line, 1773.49 feet to THE POINT OF BEGINNING, said point of beginning being also the beginning of a non-tangent curve to the left; thence southwesterly along said non-tangent curve an arc distance of 53.07 feet (delta =17°40'41", radius = 172.00 feet, chord = S64°52'28"W 52.86 feet) to a point on the southerly boundary of the tract of land described in the Quitclaim Deed with Instrument Number 654234, said point being the terminus of this centerline description. The side lines of said 26.00 foot wide strip of land are to be lengthened or shortened as necessary to intercept said parallel line and to intercept a line running S74°12'17"W through said terminus. NOTE: NO portion of Sandpoint Avenue is being vacated.

4 VAC07-04 - A request by Intermountain Community Bank to vacate that portion of a 16-foot wide alley, south of Lots 1 and 2 and north of Lots 15, 16, and 17 of Block Q, Farmins Fifth Addition, located west of Fifth Avenue between Church and Pine Streets. In exchange, the petitioner will deed the westerly 16 feet of said Lot 15 to the City to provide access to Pine Street.
