BOARD OF COMMISSIONERS' MEETING MINUTES

Tuesday, January 30, 2007

On Tuesday, January 30, 2007, the Board of County Commissioners met for a regular business meeting with the full Board present.

CALL TO ORDER

Chairman Lewis Rich called the meeting to order at 8:45AM.

PLEDGE OF ALLEGIANCE

ADOPT ORDER OF THE AGENDA

Commissioner Rich requested that discussion regarding per diem amounts allowed for county employees be added to the agenda. Commissioner Young stated that the Public Waterways Amendment Ordinance Discussion/Decision item under Miscellaneous Items be moved to 2:30 and should be held as a separate meeting. Pixie will check the tape to verify how the motion was made during the Public Hearing last week.

PUBLIC COMMENT

There was no public comment.

MEETING UPDATES

Commissioner Young presented updates on the EMS and the State Interoperability Executive Council meetings he attended last week. The needs assessment project is still underway and a National Guard presentation was given to the Council. Idaho is receiving a mobile communications unit and will be the only state receiving one.

Commissioner Rich presented an update on the Airport Advisory Board planning meeting that was held last week.

Commissioner Crossett shared information on the ITD meeting he attended in Sagle.

CONSENT AGENDA

1) Board of Commissioners' Meeting Minutes for January 23, 2007

Commissioner Young made a motion to approve the Consent Agenda as presented. Commissioner Crossett seconded. All in favor. The motion passed.

SOLID WASTE, WATERWAYS, PARKS & RECREATION and WEEDS - Leslie Marshall

1) Updates on Staff, Projects and Departments

Director Leslie Marshall presented an update on staff, projects and departments.

Director Marshall updated the Commissioners on the establishment of the waterways. There was also discussion regarding burning regulations in Bonner County.

ROAD & BRIDGE - Chuck Spickelmire

1) Updates on Staff, Road Districts and Projects

Director Leslie Marshall presented an update on staff, Road Districts and projects.

2) Request to Advertise for the 2007 Crushing Bids

Commissioner Young made a motion to approve the Request to Advertise for the 2007 Crushing Bids. Commissioner Crossett seconded. All in favor. The motion passed.

PLANNING DEPARTMENT - Clare Marley

1) Request of Approval of Surety Agreements for Quail Ridge Subdivision Improvements, Final Plat Approval, Quail Ridge Subdivision, File #S1185-05.

Treasurer Cheryl Piehl and Director Marley presented information on the surety agreement of $37,400. The next surety agreement is $5,786.66 for the improvement of the intersection. The last improvement and surety agreement is for $116,745.00, lane improvements and lane turns. All are held with a letter of agreement.

Commissioner Young made a motion to approve the Surety Agreement of $116,745.00 for the work on Spirit Lake Cutoff Road and Quail Ridge Subdivision, and the off site improvements on Dufort and Spirit Lake Cutoff Road for the amount of $5,786.66 and the offsite improvements of Quail Ridge Subdivision with an agreement with ITD for $37,400 and authorize the Chair to sign. Commissioner Crossett seconded. All in favor. The motion passed.

After further discussion, Commissioner Young moved to approve the final plat of Quail Ridge Subdivision, File # S1185-05 and authorize the Chair to sign. Commissioner Crossett seconded. All in favor. The motion passed.

2) Final Plat Approval, Bella View, File #S1177-05

After Director Marley presented an update on the requirements that were met, Commissioner Young moved to approve the final plat of Bella View, File # S1177-05 and authorize the Chair to sign. Commissioner Crossett seconded. All in favor. The motion passed.

3) Request for Fee Waiver, Granite/Reeder Water & Sewer District, Conditional Use Permit #C875-07

Commissioner Young moved to approve the Request for Fee Waiver, Granite/Reeder Water and Sewer District, Conditional Use Permit #C875-07 with the possible exceptions of outside contract of engineer work, legal notice, mailing that may be costs that they may have to pay for if we do not do them ourselves. Commissioner Crossett seconded. All in favor. The motion passed.

4) Time Extension Request - File SS1099-04, Village View

After explanation from Director Marley and hearing that civil counsel agreed with this request,

Commissioner Young moved to approve the Time Extension Request, File SS1099-04, Village View. Commissioner Crossett seconded. All in favor. The motion passed.

5) Updates on Staff, Calls, Permits and Applications

Director Marley and Treasurer Cheryl Piehl presented a detailed explanation to the Board regarding how sureties, bonds and CD's work within the county. There was discussion regarding making it equitable for all. They are checking with other counties within the State to see how other sureties are done. A recommendation will be brought forward to the Board after the legal department reviews the procedure.Commissioner Crossett moved to recess the meeting at 9:55 AM. Commissioner Young seconded. All in favor. The motion passed.

The meeting reconvened at 1:30PM.

PUBLIC COMMENT

There was no public comment during the afternoon session.

EMERGENCY MANAGEMENT, EMS and 911 DISPATCH - Bob Howard/ Steve Kukuruza

1) Update on Staff, Departments, Calls and Projects

Director Howard presented an update on staff, departments, calls and projects.

? There was discussion regarding the tower sites at Lakeview and Baldy Mountain.

Steve Kukuruza presented an update on EMS

? Ice Rescue Class was very successful this past weekend.

? Wilderness Priest Lake Class at Camel Flats was held

? The next Stakeholders meeting is tentatively set for February 22, 2007

MISCELLANEOUS BUSINESS

1) Approval of Claims for Batch #09

Commissioner Young moved to approve the Claims for Batch # 09. Commissioner Crossett seconded. All in favor. The motion passed.

2) Letter of Support for the 36th RQF (Rescue Flight)

Commissioner Young presented a letter of support to keep the 36th RQF in the Pacific Northwest. After discussion, Commissioner Young made a motion to support the letter of support for the 36th RQF and send a letters to Governor Otter, our Senators and Representatives. Commissioner Crossett seconded. All in favor. The motion passed.

3) Memorandum of Understanding for Priest River Airport and Caretaker, Gary Rogers

This is a letter of support for the caretaker, Gary Rogers who has been staying at the airport in his own mobile home, providing maintenance and acting as a security person for the past ten years. This agreement gives him permission to be there and relieves the counties liability concerns with ICRMP. Our legal department has reviewed this document. Commissioner Young moved to approve the Memorandum of Understanding giving Gary Rogers the ability to be the caretaker at the Priest River Airport for Bonner County. Commissioner Crossett seconded. All in favor. The motion passed.

4) The discussion on per diem will be tabled for today. Commissioner Young moved to table this item. Commissioner Crossett seconded. All in favor. The motion passed.

5) Treasurer's Office - Resolution to Destroy Records

After discussion, Commissioner Young moved to approve Resolution #07-08 to destroy records that do not need to be kept any longer at the Treasurer's Office. Commissioner Crossett seconded. All in favor. The motion passed.

6) Justice Fund - VAST Donations - Resolution to Transfer Funds

Commissioner Young moved to adopt Resolution # 07-09 to transfer funds for VAST for $2,500.00. Commissioner Crossett seconded. All in favor. The motion passed.

7) Major Gussenhoven - National Guard Presentation

A presentation was given regarding the desire of the National Guard to build a National Guard Armory in Bonner County. Some topics covered during the presentation included:

? Outside groups may use the facilities through a use of facilities procedure

? 55 military personnel would be housed in the facility

? Maintenance fees were discussed

? A temporary building would be built first

? Five - ten acres is desirable and an estimated land value is approximately $150,000.00

? $5.7 million is what they estimate the economic benefit to the community would be on the land investment by the county.

? 75% of the building that is for Guard use and common areas, the Federal Government pays for and 25% is paid for by the State. Additional spaces that the county might use that are not common areas or Guard use would have to be paid for by the county

? Some benefits to the community include: emergency operation facility, school and community use of facility, increased tax base to Bonner County, increased part-time employment

? 2012 is when the first brick would be laid and it would take about 18 months to build

? Homeland security and disaster services are key issues

? Shared usage

They would like to find the land and put a temporary facility next to it as soon as possible. They are interested in property adjacent to the jail. Ten acres is ideal and they must get a waiver to build on less as it limits the size and type of unit that goes in the community. There was extensive discussion regarding the area at the Sandpoint Airport. It was recommended that EMS, Airport Board, Sheriff's Office and the National Guard set another time to meet for further discussion.

Commissioner Young moved to recess the meeting at 2:28 PM. Commissioner Crossett seconded. All in favor. The motion passed.

The meeting reconvened at 2:35PM.

7) Discussion/Decision on Public Waterways Amendment of Ordinance # 406

This is a continuation of the Public Hearing held on January 23, 2007. Lou Goodness spoke during Public Comment and shared concerns about over regulations. He feels the codes already provide adequate regulations. Lt. Cary Kelly spoke regarding misdemeanors versus infractions and addressed questions from the Board and public.

After discussion, the Board requested that Lt. Kelly revise the Ordinance verbiage and bring back to the next business meeting.

Commissioner Young moved to close the hearing. Commissioner Crossett seconded. All in favor. The motion passed.

Commissioner Young made a motion to move into Executive Session under Idaho Code S67-2345S(B) regarding Personnel Matters with the full Board present as well as EMS Interim Coordinator Steve Kukuruza. Roll Call: Commissioner Young Aye, Commissioner Rich Aye, Commissioner Crossett Aye.

Commissioner Crossett moved to adjourn the Executive Session at 3:35PM and Commissioner Young seconded. All in favor. The motion passed. Commissioner Young moved to reopen the regular business meeting at 3:36PM. Commissioner Crossett seconded. All in favor. The motion passed.

Commissioner Young made a motion to hire, for a temporary five-month period of time, an ILS person for Bonner County EMS, to satisfy some of the system management needs in Priest River. Commissioner Crossett seconded. All in favor. The motion passed.

On January 24 and January 31, 2007, Assistance Director Susan Shea met with the Board for the following cases to be considered: Approved: # 2006086 Denied: # 2007029, # 2007015 and # 2007021.

There being no further business, the meeting was adjourned. The next Board of Commissioners

Meeting will be Tuesday, February 13, 2007 in the Bonner County Courthouse.

Located on Lake Pend Oreille, Idaho adjacent to: Section 23 , Township 57 North , Range 2 West; B.M., in Bonner County.

Notice is given that the (Sandpoint) Independent Highway District will meet on February 28, 2007 at 4:00 p.m. at the District office at 1805 Baldy Mountain Road, Sandpoint for the purpose of hearing public comment regarding the adoption and imposition of Fee Schedule A. The new fees relate to special permits, plan reviews, construction and/or inspection fees.
