AMENDING ORDINANCE #406 REGULATING THE OPERATION OF WATERCRAFT ON THE PUBLIC WATERS OF BONNER COUNTY, IDAHO; SETTING FORTH TERMS; PROHIBITING CERTAIN DEFINITIONS OF WATERCRAFT; ESTABLISHING SPEED LIMITS WHICH, IF EXCEEDED, SHALL BE PRIMA FACIE EVIDENCE OF PROHIBITED OPERATION; ESTABLISHING RESTRICTED ZONES FOR SWIMMING AND OPERATION OF WATERCRAFT; REGULATING THE USE OF BONNER COUNTY PROPERTY AS TO THE USE OF COUNTY DOCKS AND RAMPS; PARKING OF BOATS, MOTOR VEHICLES AND TRAILERS IN CERTAIN AREAS; BOAT LOADING AND UNLOADING PRACTICES; SEWAGE DISPOSAL; DERECLICT DOCKS AND FLOAT HOUSES; BOATER RIGHT-OF-WAY; PRESCRIBING PENALTIES FOR VIOLATIONS; SPECIFYING SEVERABILITY OF SECTIONS OF ORDINANCE; REPEALING ORDINANCE NO.'S 109 & 110.

WHEARAS, authority to enact this ordinance is granted to Bonner County pursuant to Idaho Code S67-7031(3); and,

WHEARAS, it is necessary for the protection of the health, safety, and welfare of the general public, and for the protection of public and private property, to regulate the operation of watercraft on the public waters of the State of Idaho situated in Bonner County, Idaho, but outside the municipal boundaries of the various incorporated cities within said count; and,

WHEREAS, as the Board of Commissioners specifically finds that it is necessary for the protection of the health, safety, and welfare of the general public to adopt and enforce rules and regulations governing all County owned or controlled public waters; and,

WHEREAS, Bonner County Public Waters ordinance 406 specifically grants to the Board of Commissioners the authority to regulate the operation of any motor driven watercraft upon public waters, and shall be enforced by the Bonner County sheriff's Marine Division Department; and,

WHEREAS, Bonner County Public Waters ordinance 406 specifically grants to the Board of Commissioners the authority to define, regulate and enforce any hazards to navigation that recognize the potential threat to the health, safety, and welfare of the general public and to public and private property; and

THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF BONNER COUNTY, IDAHO:

That under the section of Public Waters Ordinance #406 titled NOISE: page 4, the addition, under (A) and (B), of the new section (C) to read: C. No person shall operate, or give permission for the operation of, any motorboat on the waters of the state of Idaho that is equipped with an altered muffler or a muffler cutout, bypass or other device designed or so installed so that it can be used to continually or intermittently bypass or other wise reduce or eliminate the effectiveness of any muffler or muffler system installed in accordance with the provisions of this section.

That under the section of Public Waters Ordinance #406, titled PENALTIES: page 8, the addition, under (A), of the new sections: (B) to read: B. Any person convicted of the Noise Section of this ordinance or of the speed limits subparagraph (C) to read: C. 25 miles per hour at night and (D) to read D. 50 miles per hour during the day, shall be guilty of a misdemeanor, punishable by three hundred dollar ($300) fine or up to thirty (30) days in jail or both.

That under the section of Public Waters Ordinance #406, titled PENALTIES and before the SEVERABILITY CLAUSE, a new section be added entitled: HAZARDS TO NAVIGATION: A. No person shall place a floating object into the public waters of Bonner County that would unreasonably or unnecessarily interfere with the free and proper navigation on County waterways or that would pose a hazard to boaters in the area. These objects may be, but are not limited to, trampolines, floating islands, cubes, and swim/dive platforms. Such devices could interfere with navigation and /or pose a hazard to boaters if left out at night beyond an authorized mooring buoy or dock.

SEVERABILITY: If any of the provisions or sections of this Ordinance Amendment, or the application thereof to any person or circumstance is held by any court to be invalid or unconstitutional, such decision shall not affect the validity of the remaining provisions or sections.

EFFECTIVE DATE: This ordinance Amendment shall take full force upon its approval, passage, and publication in one edition of the Bonner Daily Bee, a newspaper of general circulation within Bonner County, Idaho.

If a hearing is requested, it shall be held before the Court alone, without a jury. Claimant will bear the burden of proof in all such cases. Petitions that fail to allege an interest sufficient to maintain a claim under S 853(n) shall be subject to dismissal without a hearing.

THE PETITION must be signed by the petitioner under penalty of perjury and shall identify the particular property or properties in which the petitioner claims a legal right, title or interest; the nature and extent of such right, title or interest in each property; the time and circumstances of the petitioner's acquisition of the right, title or interest in each property; and any additional facts and documents supporting the petitioner's claim and the relief sought. A hearing on the petition shall, to the extent practicable and consistent with the interests of justice, be held within thirty (30) days of the filing of the petition. The Court may consolidate the hearing on the petition with a hearing on any other petition filed by a person other than any of the defendants named above. The petitioner may testify and present evidence and witnesses on his own behalf and cross-examine witnesses who appear at the hearing.

1:30 P.M. - FILE VS1451-06 - OLD SPRING CREEK ROAD RIGHT-OF-WAY - ROAD VACATION - KORY HOLDERMAN is requesting Bonner County vacate (abandon) a portion of Old Spring Creek Road public right-of-way and accept the dedication of new public right-of-way as part of the plat of Holderman Estates subdivision. The subject portion of right-of-way is located +/-1.5 miles up Spring Creek Road, terminating in a dead-end. The right-of-way is located in Section 27, Township 56 North, Range 2 East, B.M. The purpose of the vacation is to provide better alignment with the existing Spring Creek Road, according to the petition.
