ORDINANCE NO. 1170

AN ORDINANCE OF THE CITY OF SANDPOINT, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, VACATING ALL THAT PORTION OF SECOND AVENUE NORTH OF THE NORTH RIGHT-OF-WAY LINE OF ALDER STREET AND SOUTH OF THE SOUTH LINE OF LOT 6, BLOCK 16, FARMIN'S ADDITION IN SECTION 22, TOWNSHIP 57 NORTH, RANGE 2 WEST, BOISE MERIDIAN, CITY OF SANDPOINT, BONNER COUNTY, IDAHO; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE HEREOF.

WHEREAS, a public hearing was held on April 18, 2007, before the Sandpoint City Council regarding this proposed vacation; and

WHEREAS, the City Council finds it to be in the public interest that said right-of-way be vacated and that it is appropriate that ownership revert to the owners of the adjacent real estate.

NOW, THEREFORE, BE IT ORDAINED, by the Mayor and City Council of the City of Sandpoint:

Section 1: That the following described property, to wit

That portion of Second Avenue north of Alder Street located directly behind the Hospital that is currently unvacated. The right-of-way is described as that portion of Second Avenue north of the north right-of-way line of Alder Street and south of the south line of Lot 6, Block 16, Farmin's Addition in Section 22, Township 57 North, Range 2 W.B.M.

be and the same is hereby vacated.

Section 2: That ownership of said right-of-way shall revert the West 1 / 2 to Bonner General Hospital and the East 1 /2 to adjoining property owners to the East, divided at the centerline.

Section 3: That the City shall retain an easement on, over and through the vacated property for the purpose of public utilities installation, service and repair.

Section 4: All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed to the extent of such conflict.

Section 5: This ordinance shall take effect and be in full force upon its passage, approval and publication in one (1) issue of the Bonner County Daily Bee, a newspaper of general circulation published within the City of Sandpoint and the Official newspaper thereof.

PASSED BY THE CITY COUNCIL as an ordinance of the City of Sandpoint on this 18th day of April, 2007.
