AN ORDINANCE OF THE CITY OF SANDPOINT, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, VACATING ALL THAT PORTION OF THE RIGHT OF WAY OF MT. MEADOWS WAY LYING EAST OF THE EAST RIGHT OF WAY LINE OF LINCOLN AVENUE, ACCORDING TO THE PLAT OF CREEKSIDE ESTATES AT MOUNTAIN MEADOWS, RECORDED IN BOOK 4 OF PLATS, PAGE 157, RECORDS OF BONNER COUNTY, IDAHO, BEING SITUATED IN THE SW _ OF THE SE _ OF SECTION 21, TOWNSHIP 51 NORTH, RANGE 2 WEST, BOISE MERIDIAN, CITY OF SANDPOINT, BONNER COUNTY, IDAHO; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE HEREOF.

WHEREAS, a public hearing was held on March 21, 2007, before the Sandpoint City Council regarding this proposed vacation; and

WHEREAS, the City Council finds it to be in the public interest that said right-of-way be vacated and that it is appropriate that ownership revert to the owner of the adjacent real estate.

NOW, THEREFORE, BE IT ORDAINED, by the Mayor and City Council of the City of Sandpoint:

Section 1: That the following described property, to wit:

All that portion of the right of way of Mt. Meadows Way lying east of the east right of way line of Lincoln Avenue, according to the plat of Creekside Estates at Mountain Meadows, recorded in Book 4 of Plats, Page 157, Records of Bonner County, Idaho, West, Boise Meridian, City of Sandpoint, Bonner County, Idaho. SW 1 / 4 of the SW 1 / 4 of Section 10, Township 57 North, Range 2 W.B.M.

be and the same is hereby vacated.

Section 2: That ownership of said right-of-way shall revert to St. Joseph's Catholic Church

Section 3: All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed to the extent of such conflict.

Section 4: This ordinance shall take effect and be in full force upon its passage, approval and publication in one (1) issue of the Bonner County Daily Bee, a newspaper of general circulation published within the City of Sandpoint and the Official newspaper thereof.

PASSED BY THE CITY COUNCIL as an ordinance of the City of Sandpoint on this 18th day of April, 2007.
