ORDINANCE NUMBER 239

AN ORDINANCE OF THE CITY OF EAST HOPE, IDAHO, PROVIDING FOR AN EXTENSION OF ITS CORPORATE BOUNDARIES INTO LAKE PEND OREILLE; AND, PROVIDING FOR BOTH AN EFFECTIVE DATE AND PUBLICATION.

WHEREAS, the City of East Hope, Bonner County, Idaho (referred to below as the "City") is empowered by Idaho Code Section 50-221 to extend its corporate boundaries into the waters of a navigable lake; and,

WHEREAS, the City is situated on Lake Pend Oreille; and,

WHEREAS, Lake Pend Oreille is a navigable lake pursuant to Idaho Code Section 58-1302(a), under the jurisdiction of the Idaho Department of Lands and the U.S. Army Corps of Engineers; and

WHEREAS, the corporate boundaries or limits of the City extend to the shoreline of Lake Pend Oreille; and

WHEREAS, the City has the power by ordinance to fix, determine or extend its corporate boundaries or limits over the waters of Lake Pend Oreille for a distance of one-fourth (1/4) of a mile from the low-water mark of Lake Pend Oreille; and

WHEREAS, the extension of the City's boundaries into lake Pend Oreille is reasonably necessary to allow efficient Administration of City ordinances and orderly use of the services of the City by land owners in the City; and

WHEREAS, it is in the best interest of the citizens of the City for the boundaries of the City to be so extended;

NOW, THEREFORE, BE IT ORDAINED by the mayor and council of the City

SECTION 1: Extension Of Boundaries into Lake Pend Oreille

The City's corporate boundaries or limits are hereby extended over the waters of Lake Pend Oreille for a distance of one-fourth (1/4) of a mile from the ordinary high-water mark (pre-Albeni Falls Dam) of such lake, with such extension being described as follows:

Beginning at the Western City limits, being described as the intersection of the line between Corner No. 4 and Corner No. 5 of the Village of Hope with the North shore of Lake Pend Oreille, being the True Point of Beginning;

Then along a line perpendicular to the shore of Lake Pend Oreille, beginning at the ordinary high-water mark (pre-Albeni Falls Dam) of Lake Pend Oreille and extending out into Lake Pend Oreille a distance of one-fourth (1/4) mile, being 1,320 feet;

Thence following a line 1,320 feet out into Lake Pend Oreille and parallel with the Northerly shoreline thereof in a Southeasterly direction to a point of intersection with the Southwesterly prolongation of the line that would be perpendicular to the ordinary high-water mark (pre-Albeni Falls Dam) of the shoreline of lake Pend Oreille at the Eastern City limits;

Thence along the afore-mentioned line 1,320 feet to the Eastern City limits, being described as the intersection of the North-South center section line of Section 1, Township 56 North, Range 1 East, Boise Meridian with the meander fine on the North shore of Pend Oreille Lake;

Thence following the ordinary high-water mark (pre-Albeni Falls Dam) of Lake Pend Oreille, constituting the Southerly boundary of the City, in a Northwesterly direction to the Point of Beginning.

SECTION 2: Effective Date.

This ordinance shall take effect and be in full force upon its publication.

Section 3. Publication

This ordinance or its summary shall be published in one issue of the Bonner County Daily Bee, which is hereby declared to be the official newspaper of the City for publication of this ordinance.

PASSED BY THE city council, and APPROVED by the mayor, under suspension of the rules, as an ordinance of the City of East Hope, Bonner County, Idaho at a regular meeting of the East Hope City Council held on
