NOTICE OF PUBLIC HEARING

Notice is hereby given that the Sandpoint Planning Commission will hold a public hearing at their meeting on Tuesday, June 19, 2007, at 5:30 p.m. in the council chambers at City Hall, 1123 Lake Street, Sandpoint, ID, to consider the following:

1. CUP05-03 (Common Knowledge Bookstore and Tea House)- A request by Natalia Ocasio and Shelby Rognstad to amend an existing Nonconforming Use Permit to allow for in-house preparation of food served in the approved cafe area, and to change their hours of operation to 7 a.m. to 6 p.m., Monday through Saturday. The currently-approved hours of operation are 10 a.m. to 6 p.m. Monday through Friday and 11 a.m. to 3 p.m. on Saturday. The bookstore was initially granted a Nonconforming Use Permit in 1999 (CUP99-03). The 300 square foot cafe was added in 2005 and is limited to serving non-alcoholic beverages and foods packaged for resale. The site is located at 823 Main Street in the Residence "B" zone and described as Lots 3 and 4, Block 15, West End Addition.

2. CUP07-04 - A request by Gloria Waterhouse for a Conditional Use Permit to allow the use of an existing, legally-nonconforming fourplex as a Tourist Home in the Residence "B" zone, for extended-stay vacation rentals of one to several weeks. The site is located at 225 / 227 South Fourth Avenue and described as Lot 8, the South 4 feet of Lot 9, and the North 2 feet of Lot 15, Block 5, Weil's Second Addition.

3. OA07-01 - The City has initiated an amendment to Sandpoint City Code, Title 9, to amend the definition of "home occupation" to include daycare for 6 or fewer children and such one-one-one uses as tutoring and music lessons; to allow Group Daycare Facilities by Conditional Use Permit in the Residence "B" zone; to prohibit commercial and private kennels in the Residence "A," "B," and "C" zones; to allow galleries as a conditional use in the Professional Office zone and as a permitted use in the Commercial "D" zone; to allow helicopter pads as a permitted use where accessory to a valid permitted use in the Professional Office and Commercial "D" zones; to modify the required front and rear yard setbacks of the Light Industrial "ER" zone; and to increase the minimum driveway aisle for 90 degree parking and the minimum permanent access easement width for lots not having frontage on a public street from 25 to 26 feet.
