SUMMARY OF ORDINANCE NO. 1183

AN ORDINANCE OF THE CITY OF SANDPOINT, IDAHO AMENDING TITLE 1, CHAPTER 4, SECTION 1, TO PROVIDE FOR MISDEMEANOR FINES OF UP TO ONE THOUSAND DOLLARS ($1,000.00) AND TO ESTABLISH A PENALTY OF UP TO ONE HUNDRED DOLLARS ($100.00) FOR INFRACTIONS; AMENDING TITLE 5, CHAPTER 2, SECTION 4 TO ESTABLISH A PENALTY FOR CAMPING ON PUBLIC PROPERTY; AMENDING TITLE 5, CHAPTER 2, SECTION 8 TO PROHIBIT CERTAIN VOYEURISTIC ACTS IN PUBLIC RESTROOMS AND DRESSING ROOMS, AND TO CLARIFY THE PENALTY FOR OBSCENE CONDUCT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE.

Section 1 provides for revisions of code section 1-4-1 to establish that every offense declared to be a misdemeanor is punishable by a fine not exceeding one thousand dollars ($1000.00) for each offense, or imprisonment in a county jail not to exceed six (6) months, or by both such fine and imprisonment; and except in cases where a different punishment is prescribed in this Code, every offense declared to be an infraction is punishable by a penalty not exceeding one hundred dollars ($100.00) and no imprisonment. Section 2 provides for revisions of code section 5-2-4 to establish that a first violation of this section is an infraction punishable by a fine not to exceed one hundred dollars ($100.00). A second or subsequent violation shall be a misdemeanor, punishable by a fine up to one thousand dollars ($1000.00) for any one offense, or by imprisonment in the county jail not exceeding six (6) months or by both such fine and imprisonment. Every day there is a violation shall constitute a separate violation/offense. Section 3 provides for revisions of code section 5-2-8 to extend the definition of obscene conduct to include such activities in and around public restrooms and dressing rooms, and to establish that the penalty for a violation of this section shall constitute a misdemeanor, punishable by a fine not to exceed one thousand dollars ($1000.00) for each offense, or by imprisonment in jail for a period not more than six (6) months, or by both such fine and imprisonment; Section 4 provides for repeal and severability; Section 5 provides an effective date.
