Notice is hereby given that petitions for annexation of real property, signed by the owners of over sixty percent of the area in land within the territory to be annexed have been filed with the board. The prayer of the petitioners is for annexation of their lands in the district. QUESTION: Shall the City of Sandpoint, Bonner County, Idaho, adopt the proposed ordinance providing for imposition and collection, for a period of eight (8) years from its effective date, certain non-property taxes this way:

A 5% hotel/motel room occupancy tax on all short term (30 days or less) rental charges for hotel rooms, motel rooms, condominium units, tourist homes, bed and breakfast establishments, and similar facilities; and

A 2% tax on alcohol, beer and wine served by the drink (or in a bottle) to be consumed on licensee's premises.

The anticipated revenue for the 5% hotel/motel room occupancy tax is anticipated to be $250,000 will be used in the following ways:

a.) City infrastructure and capital projects

b.) Street overlays, sidewalk repair, extension and replacement, and additional bike paths.

c.) Public safety services.

d.) Property Tax Relief Fund. Per Idaho Code, any excess revenue received will be placed in a designated property tax fund.

e.) Administrative costs. The city will retain the actual cost of collecting and administering the tax.

The anticipated revenue for the alcohol, beer and wine served by the drink tax is anticipated to be $50,000 will be used in the following ways:

a.) City infrastructure and capital projects.

ORDINANCE OF THE CITY OF SANDPOINT, BONNER COUNTY, IDAHO; APPROVING AND CONFIRMING THE FINAL ASSESSMENT ROLL FOR ITS LOCAL IMPROVEMENT DISTRICT NO. 2006-1 FOR SIDEWALK AND RELATED IMPROVEMENTS; IDENTIFYING THE PROPERTY AFFECTED AND PROVIDING FOR THE LEVY OF ASSESSMENTS AGAINST THE SAME; REQUIRING CERTIFICATION OF THE FINAL ASSESSMENT ROLL; REQUIRING NOTICE OF THIS ORDINANCE AND OF THE BOUNDARIES OF LID 2006-1 TO BE FILED WITH THE BONNER COUNTY RECORDER IN ORDER FOR THE FINAL ASSESSMENT ROLL AND THE ASSESSMENTS MADE BY THIS ORDINANCE TO BECOME A LIEN UPON THE PROPERTY ASSESSED; PROVIDING A DUE DATE FOR ASSESSMENTS AND FOR PAYMENT IN INSTALLMENTS; LISTING THE ITEMS OF COST; REQUIRING THE ESTABLISHMENT OF AN INSTALLMENT DOCKET; PROVIDING FOR THE AUTHORIZATION AND ISSUANCE OF BONDS; AUTHORIZING THE CREATION OF A LOCAL IMPROVEMENT GUARANTEE FUND; PROVIDING FOR AN APPEAL PROCE-DURE; PROVIDING FOR RATIFICATION OF THE PROCEEDINGS; PROVIDING FOR SEVERABILITY AND ENFORCEABILITY; PROVIDING AN EFFECTIVE DATE HEREOF; PROVIDING FOR SUSPENSION OF THE RULES AND PROVIDING FOR OTHER MATTERS PROPERLY RELATED THERETO. This Ordinance confirms the Final Assessment Roll for LID 2006-1 and places a lien against all property in LID 2006-1 benefited by the improvements therein in the amount provided in the Final Assessment Roll. Section 1 approves and confirms the Final Assessment Roll. Section 2 finds that each lot in LID 2006-1 has been benefited in the amount of the assessment levied thereon. Section 3 directs the City Clerk to certify and file the Final Assessment Roll with the City Treasurer. Section 4 directs the City Clerk to file a notice of the adoption of the Ordinance and the boundaries of LID 2006-1 with the Recorder of Bonner County, which assessments will then become a lien upon the property assessed. Section 5 establishes a due date for payment of LID 2006-1 assessments within thirty (30) days from the adoption of this Ordinance and provides that any property owner who has not paid the assessment in full with thirty (30) days shall be conclusively presumed to have chosen to pay the same over ten (10) years with the first installment due one (1) year from the date of the adoption of this Ordinance. Section 6 establishes, levies and assesses the items of cost as set forth in the Final Assessment Roll. Section 7 directs the City Treasurer to establish a Local Improvement Installment Docket for LID 2006-1. Section 8 authorizes the issuance of bonds. Section 9 authorizes the City Treasurer to fund the Guarantee Fund, if created. Section 10 provides that an appeal can be filed with the Clerk of the District Court of Kootenai County in the manner provided by Section 50-1718, Idaho Code. Section 11 ratifies all action taken by the Council and others that is not inconsistent with the provisions of this Ordinance. Section 12 provides that the provisions of the Ordinance are severable from the rest of the Ordinance in the event that they are held to be invalid or unenforceable. Section 13 provides for enforceability of the Ordinance. Section 14 provides that this Ordinance shall take effect upon its passage, approval and publication. Section 15 provides for suspension of the rules and immediate passage of the Ordinance.

The full text of Ordinance No. 1182 is available during normal business hours of the City at the City Hall of the City of Sandpoint, 1123 Lake Street, Sandpoint, Idaho. The City Clerk shall provide a full copy of the Ordinance to any citizen so requesting.

AN ORDINANCE ESTABLISHING THE HOURS OF POLLING PLACES FOR CITY ELECTIONS, REPEALING CONFLICTING ORDINANCES AND PROVIDING AN EFFECTIVE DATE.

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF KOOTENAI, IDAHO:

SECTION 1. HOURS OF POLLING PLACES FOR CITY ELECTIONS.

The polls for all general and special City elections shall be open from 12:00 p.m., Pacific Time and remain open until 8:00 p.m. Pacific Time.

SECTION 2. REPEAL OF CONFLICTING PROVISIONS.

All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed to the extent of such conflict.

SECTION 3. EFFECTIVE DATE.

This ordinance shall be effective upon its passage and publication as provided by law.

Enacted by the city council as an ordinance of the City of Kootenai on the 23rd day of October, 2007.
