NOTICE OF PUBLIC HEARING

AUTHORITY: Notice is hereby given that this agency has scheduled a public hearing and public comment. The action is authorized pursuant to Section(s) 39-416, Idaho Code.

PUBLIC HEARING SCHEDULE: Public hearing(s) concerning this rulemaking will be held as follows: October 10, 2007 at Panhandle Health District Hayden Office, 8500 N Atlas Road, Hayden, Idaho 83835 from 5:30 p.m. to 8:00 p.m. October 11, 2007 at Panhandle Health District Sandpoint Office, 1020 Michigan, Sandpoint, Idaho 83864 from 5:30 p.m. to 7:00 p.m.

Written comment will be received until the close of the October 11, 2007 hearing at the hearing site. Written comment may otherwise be submitted for receipt up to the close of business (5:00 p.m.) on October 11, 2007 to Dale Peck, Panhandle Health District, 8500 N Atlas Road, Hayden, Idaho 83835.

The sites will be accessible to persons with disabilities. Requests for accommodation must be made not later than five (5) days prior to the hearing, to the agency address below.

DESCRIPTIVE SUMMARY: The following is a statement in nontechnical language of the substance of the proposed rule change:

The negotiated rulemaking addresses revisions to the standards for on-site wastewater disposal in order to provide protection of ground and surface waters by development and adoption of dependable standards.

The proposed rule change is the addition of the following to IDAPA 41.01.100.03:

e. The determination of wastewater flow for residential structures will be based on the following:

i. Single family dwelling and mobile homes of three (3) bedrooms or less, 400 gallons per day.

ii. Single family dwelling and mobile homes of four (4) bedrooms, 500 gallons per day.

iii. Single family dwelling and mobile homes of five (5) bedrooms, 600 gallons per day.

iv. Add 50 gallons per day for each bedroom over five (5).

f. Septic tanks serving a residential dwelling unit with four (4) bedrooms or less must have a minimum liguid capacity of one thousand (1000) gallons. For each bedroom over four (4) add two hundred fifty (250) gallons of liquid capacity.
