(12) Whenever all or a portion of any obligation secured by a deed of trust which has become due by reason of a default of any part of that obligation, including taxes, assessments, premiums for insurance or advances made by a beneficiary in accordance with the terms of the deed of trust, the grantor or his successor in interest in the trust property or any part thereof, or any beneficiary under a subordinate deed of trust or any person having a subordinate lien or encumbrance of record thereon, at any time within one hundred fifteen (115) days of the recording of the notice of default under such deed of trust, if the power of sale therein is to be exercised, or otherwise at any time prior to the entry of a decree of foreclosure, may pay to the beneficiary or their successors in interest, respectively, the entire amount then due under the terms of the deed of trust and the obligation secured thereby (including costs and expenses actually incurred in enforcing the terms of such obligation and a reasonable trustee’s fee subject to the limitations imposed by subsection (6) of section 45-1502, Idaho Code, and attorney’s fees as may be provided in the promissory note) other than such portion of the principal as would not then be due had no default occurred, and thereby cure the default theretofore existing, and thereupon, all proceedings theretofore had or instituted shall be dismissed or discontinued and the obligation and deed of trust shall be reinstated and shall be and remain in force and effect, the same as if no acceleration had occurred.

HOPE PUBLIC HEARING

NOTICE

The Hope City Council will conduct a public hearing on Wednesday May 14, 2008 beginning at 6:30 p.m. regarding: The elimination of the R-2 Residential District and adoption of two new zoning districts, R-2.5 Rural Residential and R-5 Rural, and related permitted uses, conditional uses and development regulations. The R-2.5 district requires a 2.5 acre minimum parcel size. The R-5 district requires a 5 acre minimum parcel size. Additionally, the City Council will consider the adoption of an amended Zoning Map so as to designate existing R-2 District lands as R-1 Residential and rezone existing R-1 lands on the steeper slopes generally located above existing development as R-2.5 Rural Residential and R-5 Rural. Pursuant to Section58-104(g) and 58-1301, et seq., Idaho Code (The Lake Protection Act) and rules of the State Board of Land Commissioners, notice is hereby given that Bonner County Public Works, 4100 McGhee Rd., Suite C, Sandpoint, ID 83864 has made application to construct and maintain a concrete panel and concrete redi-block, shore line retaining wall at their public launch facility in Coolin, ID. The retaining wall is in two sections, separated by the existing launch ramp. South from the ramp will be a combination panel and redi-block wall approximately 36 feet long. North from the ramp will be a redi-block wall 65 feet long. Base of each wall will be approximately 2.5 feet below the lake’s summer pool level. Each wall will be riprap toed with 24 inch + clean angular rock. Wall height is approximately 7 feet. Located on Priest Lake, adjacent to: Tax Number(s) 43, Parcel Number RP59N04W103900A and the terminus of Slee Street, Section 10, Township 59 North, Range 4 West B.M. in Bonner County.
