NOTICE OF PUBLIC HEARING

Notice is hereby given that the Sandpoint Planning Commission will hold a public hearing at their meeting on Tuesday, August 5, 2008, at 5:30 p.m. in the council chambers at City Hall, 1123 Lake Street, Sandpoint, ID, to consider the following:

1. ZC08-03 – A request by Bruce Pedersen for a zone change from Residence “B” to Commercial “D” for approximately 1.7 acres located north of Church Street, south of Cedear Street, east of Boyer Avenue, and west of Sixth Avenue. The property includes the site of St. Joseph’s Catholic Church, parsonage, associated buildings, and parking area, and is described as Lots 1 through 3, Block O, Farmin’s Fifth Addition, Lots 1 through 7, Block 30, West End Addition “D,” Lots 2 through 4, Block 2, Law’s Third Addition, and the West 80 Feet of Lot 2, Block 29, West End Addition “D.” The City has added Lots 4 through 6, Block O, Farmin’s Fifth Addition, and Lot 1, Block 2, Law’s Third Addition to this request to maintain consistency.

2. OA08-01 – The City has initiated an amendment to Sandpoint City Code, Title 9, to revise existing standards for attached accessory dwelling units, create standards for detached accessory dwellings units, and to allow accessory dwellings units as a permitted use in the Residence “B,” “C,” and Rural Residential “RR1” zones, and by Conditional Use Permit in the Residence “A” and “A7” zones.

3. OA08-02 – The City has initiated an amendment to Sandpoint City Code, Title 9, to set certain frontage and square footage standards where residential uses are combined with permitted business uses in the Professional Office and Commercial “D” zones and the Commercial “D” Overlay District, and to allow for exceptions to such standards by Conditional Use Permit in the Professional Office, Commercial “D,” and Light Industrial “ER” zones and the Commercial “D” Overlay District.

4. OA08-03 – The City has initiated an amendment to Sandpoint City Code, Title 9, to provide for a reduction in parking requirements for developers seeking to rehabilitate or expand existing structures in the downtown that are listed on the National Registrar of Historic Places.

Copies of the ordinances and the complete files for the above are available for review at the Sandpoint Planning Department. Any written testimony of more than one page to be considered at this meeting must be delivered to the Planning staff six days before the meeting date. NOTICE OF HEARING ON NAME CHANGE

A Petition to change the name of Mary Margaret Barkley, born May 16, 1991 in Spokane, State of Washington now residing at Nordman, ID has been filed in Bonner County District Court, Idaho, Case No. CV-2008-01156. The name will change to Mary Margaret Mann because mom was single at time of Mary’s birth and is now married and wants Mary to have the same last name as mom. The child’s father is unknown. The child’s mother is living.

A hearing on the petition is scheduled for 9:30 o’clock a.m. on August 18, 2008, at the County Courthouse before the Honorable Debra A. Heise. Objections may be filed by any person who can show the court a good reason against the name changes.

1. ZC08-02 - A request by Whitewater Creek Development for a zone change for an approximately 33.89-acre parcel located north of Woodland Road west of its intersection with North Boyer Avenue.

The Applicant is requesting the zoning be changed from Residence “A” to Residence “C” for approximately 30.10 acres described as the SW 1 / 4 of the SW 1 / 4 of Section 3 lying east of the railroad right-of-way, except the East 100 feet, and the NW 1 / 4 of the NW 1 / 4 of Section 10 lying east of the railroad right-of-way, except the East 100 feet, and except the South 225 feet, all in Township 57 North Range 2 W.B.M. The Planning Commission has recommended approval of this portion of the request.

The Applicant is further requesting the zoning be changed from Residence “A” to Light Industrial “ER” for approximately 3.79 acres described as the South 225 feet of the NW 1 / 4 of the NW 1 / 4 lying east of the railroad right-of-way, except the East 100 feet, and except the South 25 feet for road right-way, in Section 10, Township 57 North, Range 2 W.B.M. The Planning Commission has recommended approval of this portion of the request subject to a development agreement.

The following Conditional Use Permit applications were granted by the Planning Commission, contingent upon approval of the requested zone change noticed above.
