Trial pending in drug sweep

SANDPOINT — Three people have been sentenced and a fourth person is awaiting trial in connection with a sweeping marijuana investigation in Clark Fork earlier this year.

Danny Charles Allen Marshall is scheduled to be tried in 1st District Court in June on four counts of delivery of a controlled substance. He’s also charged with misdemeanor possession of pot and paraphernalia, charges which are expected to be consolidated with his felony drug-dealing case.

Marshall, 37, of Clark Fork, is accused of supplying marijuana on four occasions in December of last year and January. In several of the instances, Marshall allegedly sold the drugs to an undercover drug agent from the Bonner County Sheriff’s Office, according to court documents.

Marshall is free on bond while his case is pending. If convicted, he faces up to five years in prison and $15,000 fines on each count.

In related developments:

? Kalani Robert Cody Boward, 18, of Clark Fork, entered into a plea agreement with the state and was sentenced last month for delivery of a controlled substance.

He was given a suspended prison sentence and ordered to serve 30 days in jail. He was given credit for 13 days already served, leaving a balance of 17 days, court records indicate.

? Walter Kenneth Hayes IV, 21, of Clark Fork, also entered into a plea agreement which led to the dismissal of three delivery charges.

He pleaded to delivery of a controlled substance and possession of OxyContin.

He was given a suspended prison sentence of two to five years and ordered last month to serve 60 days in jail on both counts.

The sentences run concurrently and he was given credit for 10 days, records show.

? Valerie Sue Marshall, 49, of Clark Fork, took a plea deal which downgraded a felony delivery charge to possession of paraphernalia.

Another paraphernalia charge was dismissed and she pleaded to misdemeanor pot possession.

She was sentenced in February to concurrent, year-long jail terms. She was given credit for 13 days, court documents said.

? Robert Joseph Newer, 63, of Hope, pleaded guilty to possession of pot with intent to distribute.

A plea agreement proposes 90 days in jail and an underlying suspended prison sentence. In exchange for the plea, the state has agreed not to pursue a drug delivery charge, court records indicate.

He is scheduled to be sentenced later this month.

The drug transaction and possession charges in each of the five cases cover a span of time from November 2008 to January.
