State moves to revoke bond

SANDPOINT — The prosecution is moving to revoke the bond of a Bonner County woman awaiting sentencing on a voluntary manslaughter charge.

Bonner County Prosecutor Louis Marshall alleges Lorraine Kathryn Kenitzki has violated the terms of her conditional release by failing to submit to a presentence investigation and harassing her estranged husband, according to court documents.

A hearing on the state’s motion is planned for March 24, the same day Kenitzki’s sentencing hearing was set for. The sentencing hearing is being vacated because of the absence of a presentence report, a document which details a defendant’s background

and the circumstances surrounding the offense they are charged with.

Kenitzki, 45, is accused of shooting Erik David Foust to death on Oct. 6, 2010. The shooting occurred inside a recreational vehicle parked outside the Green Owl Tavern north of Priest River.

Kenitzki is free on $10,000 bail, a sum which set when she was charged with involuntary manslaughter.

“At the time, it was uncertain from the State’s perspective whether or not the shooting was accidental,” Marshall said in the motion.

Investigators subsequently concluded that Kenitzki intentionally shot Foust in the heat of passion. She has described Foust, 41, as her boyfriend.

Kenitzki entered an Alford plea to the amended charge in 1st District Court in January. Under the plea, Kenitzki admits no wrongdoing but concedes she could be convicted of the offense if it went to trial.
